How is a “holiday” visa different than a “tourist” visa?? 


I understand Australian doesn’t directly overlap with British, but a holiday is a visit last time I checked.

It may be the equivalent of a "working holidaymaker" visa -- I held one myself in the mid-90s for the UK. I was permitted to work for six months under the terms of the visa.

No, my husband did not do any kind of work. I’ve studied Australian migration law as part of my Law degree and would not risk him having his visa cancelled due to his “no work” condition. 

I was the sole provider for our family.

2 April 2018: Married in Santa Ana, California 💒

6 June 2019: Birth of our daughter 👶👨‍👩‍👧

14 October 2019: Sent I-130 package via AusPost 📮 

18 October 2019: NOA1 received - sent to Texas Service Centre :D

24 October 2019: USCIS processed filing fee 🤑 waiting game 🕰️

22 January 2020: Andy moved back to the USA😞 🇺🇸 - re-establish domicile & to get a job 👨‍⚕️

23 February 2020: Petition transferred from Texas Service Centre to Nebraska Service Centre 😞

15 May 2020: I-130 petition approved! 😭😍 Date changes leading up to the approval were: 1 May, 12 May, 13 May. 

16 May 2020: Received NVC email, paid all fees. Waiting for fees to process so we can upload and submit all documents

19 May 2020: Immigrant visa Fees PROCESSED; affidavit of support fee PROCESSED 

28 May 2020: Submitted VISA application, civil documents & affidavit of support documents. Patiently awaiting DQ. 

2 June 2020: Email received from NVC stating that we have been Documentary Qualified and that they will liaise with US Consulate in Sydney for Interview 🐨

27 June 2020: Expedite request submitted 🤞

7 July 2020: Expedite request APPROVED! 😃😭

15 July 2020: Email received advising of interview date and time. 
20 July 2020: Medical i: n Melbourne CBD 🏥     
28 July 2020: US visa interview at US consulate Sydney - refused 221(g) issued. Request for joint sponsor 😞

31 July 2020: uploaded joint sponsor to NVC, emailed consulate 

5 August 2020: emailed received advising they have received the joint sponsor 

7 August 2020: case i0n “administrative processing” 🤞

10 August 2020: visa ISSUED 😭

two incorrect statements actually.. 

1) he was on work holiday visa that permits work

2) for foreign parents of Aus Citizens is also incorrect. Extensions apply to everyone under specific conditions, not just our parents. 

 

And anyone one can say they used to work for the Australian embassy, it dosent mean they did nor does it mean in the capacity of an Australian official.. everyone needs cleaners I guess

Timeline

I can only recount my personal experience. Entered on VWP with boyfriend, a USC (we met in another country, not in the US  nor my home country) to meet his family and yes, possibly get married. 

I was completely ignorant of immigration processes beyond ruling out K-1 since it sounded complicated & I qualified for VWP. (I had no idea at the time you had to file for AOS from K-1, either.)

The plan at the time was enter in June, meet his family, see where he lives, get married if we so choose then both of us would leave within the 90 days so we can go visit the rest of my family in Hungary, my home country. 

What I did NOT realize then but realized only after the wedding was that if I left the country I couldn't come back without going through the spousal visa process, which takes a year.

Having just gotten married, we quickly scrapped the going to visit my family plan and filed for AOS instead.

Visiting my family got pushed back repeatedly, we finally managed it 6 years later. I was a USC by then having gone through ROC & naturalization. We also had our 3 kids by then.

Genuinely no intent to adjust at POE (there was intent to marry, yes, not against the law) until I actually sat down months later & started to learn what the process entailed.

2) I never said it was only for foreign parents. I said it was generally given to foreign parents. And I wasn't talking about extensions, my apologies if I didn't make it clear. I was referring to visas that are issued with a one year stay permission.

 

Other than cleaners, you know what else we all need? Manners.

You YOURSELF benefited from lax tourist visa rules in another county. How is okay okay for you then but you’re going to act like if anyone else benefits, it’s wrong. From the sounds of it, you didn’t even spend that much time apart during your consular processing? He JUST moved back  to establish domicile.

He didn’t just move back to re-establish domicile, that is the part we have shared with the public but his Australian tourist visa expired and he didn’t want to stay here permanently and the money he brought over “ran out” and had to move back to the states to pay his bills?

There are so many worse injustices in this immigration system. I wish you were more passionate about those.


I can if I wanted to enter on my tourist visa and adjust my status. 
 

Should I? No. That’s not the correct process. 
 

 

How do you know what I am passionate about by ONE post? 
 

there are many injustices within the Australian migration system too. 
 

you can be frustrated (or jealous) and you can be also be outraged of those injustices too. They are not mutually exclusive. You can be both, at the same time! 

 

And yes, I have not only studied lawyers ethics but I was the top of my class for that subject too. A feeling of frustration (or if you’d like to call it jealousy) does not mean that someone will not do their job ethically.

People have been cautioned again claiming they “moved” on tourist visas in the past, I’m just saying it sounds/looks bad. If you can try and paint everyone who adjusts from a tourist visa in a certain way without knowing the facts, you should be able to see how that can be looked at with a negative perspective as well.

 

Either way, I hope you realize how lucky you were that the year visit was even an option for your husband. Even if you weren’t able to stay together with him in the US from a tourist visa, you yourself definitely have been given some options that people from other countries could point at as unfair. There is always someone who has it easier than you, and always someone who has it worse as well. 
 

Instead of knocking down those who had it easier, try being thoughtful about those who have had it worse.
