I said stupid about the waiting time.. does not make no sense at all.. waiting 15 years for a visa it’s stupid.. It will be better  if they cancel they hole siblings sponsorship .. not allowing citizens to file to bring siblings but only after more than a decade.. do you see my point of view here?!!

my wife's dads brother just came over on the sibling visa in September 2019, he waited like 14 or 15 years or so, now he is over here working away and enjoying America, it's a long wait but well worth it for people from non first world countries in my opinion.

No. Someone explained to you the reason, you may think it’s stupid but most people don’t. If everyone else agreed with you and no one else filed and everyone else waiting cancelled their petitions, then guess what...there would be no wait.

Again, you miss the point. If it was only people filing and hardly anyone ever bothering to take up the visas, again there would be no wait. The quota is visas issued, not people on the waiting list.

But by all means, if you think it’s all stupid, don’t file for your brother.

Plenty threads going on about immigration reform in relevant parts of the forum.

Right OP I think you are missing on how the Priority Dates work. You can file now and your petition could be approved in a year from now. But its going to sit until the Priority Date becomes current, which will take 10-15 years. The priorty date advances as the backlog clears out. The yearly quota available resets every october as that is the beginning of the fiscal year.

People who file and dont follow through are not taking a visa away from another person.

But it’s not the government that decides how long you wait. The government releases a generous number of visas each year. Unfortunately for you (and your brother), many more people want the visas than there are available. So it’s the other people making you wait. If fewer people applied, your brother would have his visa immediately.

Timeline in brief:

OP, I  don't think you have a firm grasp of how family preference visas work.  You are mad because other people are in line ahead of you?

I would think that as an immigrant yourself, you would have some understanding of US immigration processes.

I understand what you are saying.. but I don’t think all the siblings of the us citizens Born outside of the country want to move here..One of siblings wants to live here the others not.. do you see what I’m talking about?! however as a us citizen no one can ban you from bringing your family to live with ya or at least to visit ya..

Congress may someday eliminate the F4 immigrant preference category for siblings.

One of the proposals that Congress regularly brings up when discussing comprehensive immigration reform is to STOP 🛑  allowing US citizens to petition for green cards of their siblings.  President Trump has been pushing for an end to so-called chain migration into the US, even proposing cutting off visas for all immigrating relatives other than spouses and minor children.

Although Congress had made no changes at this time, you can expect additional efforts in the upcoming years. The good news is that all visa petitions before the law changes would likely be allowed to go forward. To be safe, if your brother wishes to live in the US permanently, it might be worthwhile to apply for a green card as soon as possible and get in line.

I forgot to state that having a visa petition I-130 on file carries certain risks. Specifically, it could cause him problems when he applies for tourist or other temporary visas, because the State Department will know that he also has plans to stay in the US permanently.  He will then have to prove to the government that he intends to return to his home country when applying for B1 or B2, or to CBP if he’s on VWP.

You and he should be aware of this risk before petitioning.

Have a good immigration journey.
