I have my citizenship interview next week after which i will be filing the I-130 form for my husband. I saw online that i could file a k-3 visa which i understand is the same as the I129f form. Can someone confirm? I've been told that the fiance visa takes a much shorter time to process so is it possible to file a fiance Visa eventhough i am already married? All answers/experience welcomed. I am in Florida btw. Thanks in advance!

All bets are off if you are married. The K-1 visa is for those who want to come to the US and determine if this is the one you want to spend the rest of your life with.

I read on the USCIS website the the k-3 Visa can be filed while the i130 is waiting approval. Any info on that process?

So you want do divorce your husband so he can get to the US faster?

No fiance visa, you are already married, not fiances. K3 visa is no longer issued. Read the guides on CR1/IR1

No. CR1/IR1 spousal visa is your only option

Ok thank you. I am doing research but it gets confusing. I thought the k-3 visa was is now the i129f form.

Yes, the I129f can be used in addition to an I130 for a K3, however the K3 is no longer issued anymore. Last year there were only 4 issued, and the number is growing smaller every year, if any are even issued this year at all (likely not). Meaning, you will not receive a K3, IR1/CR1 is your only option. No faster way

It isn't too far of a leap.  To use the fiancee visa both martpies must be free to marry.

Everyone wants there fiancee or spouse here faster.

 

When did you marry?  Why didn't you file as a LPR?

Got married jan 11. my citizenship interview date is Tuesday. I was thinking it would be easier to wait until my naturalization to start the filing.

Nothing is fast in US immigration.  It will take at least a year.

Are you planning to wait until after the oath to file the I130?  If so, it may be 30 or more days from the interview depending on the locality.  Btw, there are a lot of stories circulating that when filing an I129 (K3) with an I130 (CR1/IR1), it speeds up the overall process.  YMMV on that one, but feel free to try.  Regardless as others have said, the eventual visa will almost certainly be a CR1.  However, you may not be able to file the I129 as an LPR, so that may have to wait until after the oath ceremony, but you can get the I130 clock ticking and upgrade it after your oath.

Yes i have seen that where other's have said they filed i129f with the i130 and it was approved faster. Do you know if the i129f has a different processing fee? i think i might go that route because i also read that i cannot file the i129f until i get the first letter (one where they tell you they have started the application) for the i130 form. Im guessing by the time i get that letter i should be a citizen.
