Is this the correct way to answer "What is your current spouse's legal name?" when beneficiary's passport has two word "Given name" but no "Surname"

Currently stuck on this part of I-130 form. The question posed is  "What is your current spouse's legal name?". Below are the beneficiary's passport details:

 

Passport Details:

 

Surname: ______ (it is blank)

Given Name: Jane Smith

 

On the I-130 I have filled it out in the following way, is this correct?

 

First Name: Jane

Middle Name

Last Name: Smith

Go with what’s written on her birth certificate unless legal name change has happened via marriage etc... you’ll need to upload the marriage certificate anyway. That will have her true name plus your surname on it and will support legal name change.

 

if the passport is incorrectly stating her name, it’s that what’s needs changing nothing else

If she has no surname, don't enter a "Last Name".  Just exactly what is the question.  Usually forms indicate family name, and do not ask about "current legal name".  Answer the exact question.  It's common in Indonesia, for example to have only one name or two given names.

Facts are cheap...knowing how to use them is precious...

This is the exact question "What is your current spouse's legal name?" and the beneficiary's passport is correct there are no errors, it correctly shows a two word "Given Name". The online USCIS I-130 form has sections for "First Name", "Middle Name", "Last Name".

 

So my question becomes how do I correctly input a two word "Given Name" into a form, "First Name", "Middle Name", "Last Name"

I can attach a screenshot, am filing online through the USCIS website and unfortunately it does not give me page and section numbers.

 

Based off our previous conversations I went ahead an put the entire name "Jane Smith" in the "First Name" section but I still would like for you to review it for assurance. Thank you!

Is that the online I-130 form or something else.  The actual PDF form does not have that question.  Either way, you do not enter a surname for a person who has no surname.  Whether you put two words in two spaces or in just one space doesn't really matter.

Does she have a surname? If not then don't put anything under last name as she does not have one

  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!
