Timeline

Hi VJ Family, 

 

I'm filling petition for my father who lives in Pakistan, he first got married in 1978 and got divorce in 1983 and remarried my Mother. He doesn't have his first marriage papers or divorce papers, it appears that i have to submit the divorce papers with his i-130 petition. 

 

1. Should i file the petition without divorce papers?

2. How to get his 1st marriage related document?

 

Any help will be highly appreciated.

but his first marriage was not recorded. would they be able to make it for him if he provide dates?

I have the marriage certificate with my mom but divorce papers from previous marriage is missing. i asked him to contact the union council today.

Bribing  to produce fake documents is not the way to go.

Don't file without all required documents. You may get an RFE. You may get an outright denial per the updated USCIS policy to do so in exactly this type of situation (filing hoping to get an RFE with a document later).

 

Do not present any false documents. This especially goes to anybody from Pakistan as they review documents very carefully for exactly that type of reason.

Jokes aside, it is against US immigration law to present fraudulent documents, and also against VJ terms of service for someone to advise bribing officials to get them for use in the US immigration process.

 

This part of the US immigration manual https://www.uscis.gov/policy-manual/volume-8-part-j-chapter-2 deals with the penalties (that is, “The person will be barred from admission for the rest of his or her life”)  for fraud and willful misrepresentation. Again, getting a fake document and presenting it at interview would be totally, totally dumb.

Does it apply to my mother too? my mother only married once. if i were to petition for my mom, do i have to submit my father divorce papers too?

No.  For that you will need your birth certificate and possibly your parents' marriage certificate.
