Hi , here are questions (1) is my spouse can take my name on her bank account , insurance and all possessions even I m not in USA yet 

(2) does she can change her name and take my name even our petition is still under process ?? And if yes ! wouldn’t it effect our case ?

Yes she absolutely can do that. Easiest way is go to social security office with marriage certificate and fill out the form. Harder way but possible (the way i did it) go to her local court and file a form pay the fee and submit marriage certificate as well as document of current name to petition a legal name change. Once it is granted, all she has to do is give notice to ss office and any other agency or company she does business with.

A little clarification needed.. you are married and your wife wants to take your last name correct? 
 

if so then she can go to social security and change her name with your marriage certificate, obtain a new ID, and change her name on all her accounts/documents.

Wouldn’t it effect our I-130 spouse petition ,which is still being processed  ,if she change her name during this ??

We did exactly that and faced absolutely no problem throughout the process.

Yes I m married, so wouldn’t it effect our I130 spouse petition if she do now !!??

There should be absolutely no problem. I did that exact thing during our own process for CR1. I just provided documentation at the appropriate time to keep everything up to date much as you would any other critical information.

Our process is still processing in USCIS with her previous name , so if they change name now and after case will go to NVC , it will not create  any confusion to them ??? So my wife have to renew all her documents (citizenship, ID, etc ) ? and shall we have to provide all new documents with precious one at NVC level ??? Thank you so much

no. the marriage certificate is proof of the name change. nothing else is needed as far as USCIS is concerned. Once she changes her name on her drivers license or state ID, that with a copy of the marriage certificate is all that is needed for other financial institutions.

10/14/21 (havent heard anything... when do i start to get worried?)

Not only is the spouse name change a non-issue for the petition process, there is not even a need to notify USCIS.  Your wife can just use the married name on all subsequent paperwork at the NVC stage.  

 

Even government employees can understand that Mary Jones is now Mary Smith, if the beneficiary spouse is John Smith.

Facts are cheap...knowing how to use them is precious...
