Hello everyone! I’m an American citizen and want to make a petition for my brother, he is 45 and is married and has a little son. I would like to know what documents do I need from them and how is the process. Thank you!

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Refer to USCIS website, file petitions per below link... it will be a long slow process

  • EAD approved 12 March 2021

  • EAD Card Received 1 April 2021  
  • Case under review 2 April 2021
  • New Card is Being Produced 25 September 2021

As @missileman pointed out, it will take more than 10 years. But it really will be about 15 - 20 years because the timelines for sibling visa keeps getting longer. 

 

So your brother won't be in the US until he is 60 - 70 years old. Then he may have other things to worry about like healthcare cost.

Don't know where you got this information, but right now the most recent sibling visa (i.e., the most recent priority date) being processed is Nov. 22, 2006 -- that's already almost 13 years.  Add in the visa processing time and right now it's -- at an absolute minimum -- 13 1/2 to 14 years, more likely more than that.  And, that timeline is only going to continue to grow longer as more people apply for their siblings in response to all of the discussions that this visa category might be canceled as part of immigration reform.

 

Whether your brother is okay with the wait isn't really the issue.  He will be close to or more than 60 years old when he immigrates.  How does he (and how do you) plan to support his family -- especially with a teenager to raise?

You missed the point. The process time is growing and growing every year. So don’t rely on the 12 year time frame. Because 5 years f ok now it may be up to 20 years. Sibling timelines do NOT freeze. 

 

Also, what country are they immigrating from because that plays an important role.

So, here is the thing, it is not a steady process. The wait time is because the numbers are limited by quota per fiscal year. Every year the queue grows as the increasing population in the US filed petitions for an increasing number of potential immigrants, but the absolute number granted visas each year doesn’t change. So those at the back of the line end up waiting longer and longer because there are way more people in front of them than the people 13 years ago who are currently getting visas, had. 
 

Does your brother realize the implications of not being able to work a full 10 years in the US before retiring, especially when it comes to healthcare costs ? Has he looked at university fees here for his son? Hopefully he has done all this and has good plans.

I don't know about the US when it comes to issuing visas, but here in Aus they wont issue you a visa if you are over a certain age as you become a potential healthcare risk (i.e needing to use our health care system cause you get older). 

 

Our Visa Journey:

 

2 April 2018: Married in Santa Ana, California 💒

6 June 2019: Birth of our daughter 👶👨‍👩‍👧

14 October 2019: Sent I-130 package via AusPost 📮 

18 October 2019: NOA1 received - sent to Texas Service Centre :D

24 October 2019: USCIS processed filing fee 🤑 waiting game 🕰️

22 January 2020: Andy moved back to the USA😞 🇺🇸 - re-establish domicile & to get a job 👨‍⚕️

23 February 2020: Petition transferred from Texas Service Centre to Nebraska Service Centre 😞

15 May 2020: I-130 petition approved! 😭😍 Date changes leading up to the approval were: 1 May, 12 May, 13 May. 

16 May 2020: Received NVC email, paid all fees. Waiting for fees to process so we can upload and submit all documents

19 May 2020: Immigrant visa Fees PROCESSED; affidavit of support fee PROCESSED 

28 May 2020: Submitted VISA application, civil documents & affidavit of support documents. Patiently awaiting DQ. 

2 June 2020: Email received from NVC stating that we have been Documentary Qualified and that they will liaise with US Consulate in Sydney for Interview 🐨

27 June 2020: Expedite request submitted 🤞

7 July 2020: Expedite request APPROVED! 😃😭

15 July 2020: Email received advising of interview date and time. 
20 July 2020: Medical i: n Melbourne CBD 🏥     
28 July 2020: US visa interview at US consulate Sydney - refused 221(g) issued. Request for joint sponsor 😞

31 July 2020: uploaded joint sponsor to NVC, emailed consulate 

5 August 2020: emailed received advising they have received the joint sponsor 

7 August 2020: case i0n “administrative processing” 🤞

10 August 2020: visa ISSUED 😭 

12 August 2020: passport and visa in hand!

The INA doesn't have a max age limit. That said, age is one of the factors to be taken into account for "likely at any time to become a public charge" per INA § 212(a)(4): https://uscode.house.gov/view.xhtml?req=granuleid%3AUSC-prelim-title8-section1182&num=0&edition=prelim

The US is not nearly as harsh as Australia on public charge healthcare concerns, in fact Australia is brutal. I’ve had friends with an autistic child refused an immigrant visa because of the child, and an uncle already resident (but not yet a citizen) in Australia get kicked out after having a stroke.

Age is an issue in the US, but it can be overcome as a concern if the sponsor is sufficient.

At this point you just need documentation establishing your sibling relationship: https://www.visajourney.com/content/ussibpet/ When the Priority Date becomes current many years from now you'll submit further documents.
