Police clearance certificate doubt for filing IR1- DCF

Hi Guys ,

 

I am filing i-130 for my spouse and we both live in India. I am also aware that we don't need PCC to file i-130.

 

So we require PCC for my spouse at the next leg of the visa processing and my question is around the countries for which he would require PCC.

 

We have been living in India for the past 9 months and he was living in Australia before that for 2 years . Does he also require PCC from Australian police as well or just the PCC from Indian Police would suffice?

 

Any help is greatly appreciated .``

 All the countries he lived for more than 6 months. 
so yes. India and Australia PCC is required

I believe it's actually 12 months for CR/IR-1. 6 months is the K-1 requirement (and 6 months for the country you're applying from).

It's 6 months all across the board. If anyone lives anywhere for more than 6 month after their 16th birthday, they need to have police certificate for that country.

Don't confuse IR requirements with K1

My bad. Its actually 12 months. 
if you live in any other country for more than 12 months and were 16 years or older. You need that country’s police clearance certificate. 

and 6 months is for the country you are currently living in. 
 

so above member is correct. 
 

anyways. OP need both Indian and Australian PCC

So we have taken an Australian PCC in 2017 while we were living there. Can we use the same one since we aren't living there anymore or we need to get a new one ?

Also,  if you have a PCC that you received upon departure from that country,  and you have NEVER stepped foot back inside that country (for any reason), the PCC you already have would still be valid regardless of when it was received. 

 

 

We took PCC in Jan' 18 and left Australia in Dec'18 .. 

 

Since we left Australia before his PCC expires should we take a new one .. really confused ..

Yes,   because you were in country after the date of the PCC therefore the validity date is only one year from issuance

New one.  They expire.

A PCC remains valid even after expiration if somebody has never returned.

That said, the above has not stopped it from being requested. To steal a phrase, the one with the gold makes the rules.

Expiration dates on police certificates are not relevant to US Immigration.  It's the issue date that matters.  For the country of current residence, it must be issued within 6 months of the visa interview.  For countries of previous residence, it must be issued timely to the end of residence in that country.
