PAST MISREPRESENTATION CASE

SO I APLLIED FOR AN F1 VISA IN 2010. I BELIEVE I WAS REFUSED/DENIED BECAUSE ONE OF THE DOCUMENTS I SUBMITTED WASNT ORIGINAL(FORGED). I LATER GOT TO KNOW THE DOCS I WAS HANDEE TO PRESENT AT THE EMBASSY BY AN UNCLE WASNT ORIGINAL. BEFORE THAT I HAD VISITED USA IN 2009 AND 2010. I MET MY FIANCE IN 2010 IN THE STATES. WE HAVE BEEN TOGETHER SINCE 2010. WE HAVE MET TWICE SINCE THAT PERIOD. ONE IN LONDON AND THE OTHER IN South Africa ABOUT 6 MONTHS AGO. SHE FILED FOR K-1 VISA IN MARCH,2019 AND WE RECEIVED OUR NOA2 3/06/2019. NOW MY PROBLEM IS THAT MY PAST VISA DENIAL IN 2010 WILL COME HAUNT US. PLEASE CAN WE OVER COME THIS HURDLE? CAN SOMEONE HERE WITH SIMILAR EXPERIENCE SHARE. NOTE, I SUBMITTED THE DOCS BUT I DIDNT DELIBERATELY SUBMITTED THOSE FORGED DOCS. THANKS

Without your nationality and the document in question we would all be guessing.  You didn't receive anything fro the CO about the rejection?   

 

Usually misrepresentation is a lifetime ban.

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Timeline

What country are you from/ what document was forged and why? This can have a huge impact on your current petition.

 

as someone else said, generally misrepresentation is typically a lifetime ban.

 

and please dont use all caps. my old eyes can't handle it.

i 485, 130, EAD and AP

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

I am from Ghana. I was given a generic letter. I had travel to the USA twice before applying for the F1 visa. At my interview I was asked to go and that the embassy will contact me. I was called to come back after a couple of days. when I got there the CO asked who gave me the docs(bank statement) and I said my uncle. That was he gave a generic refusal letter. it was later I got to know from a family member that I was given a forged statement from by uncle.

sorry for using caps. It the bank statement my uncle gave me for sponsorship.

ghana is a tough consulate since it is considered a high fraud country.

 

how was a bank statement forged and why? did your uncle edit it to reflect more money in the account?

 

Do you have a copy of that letter we could see?

Honestly do not how it was forged. That was about 10 years ago. do I need a lawyer for the petition?

If the letter didn't say the visa was denied for Misrep then you are probably ok.  You must still state you were denied a visa when you file the DS-160.  When you interview expect some questions about the past application.  If it was for Misrep you will find out at the interview.

That really helps. I will definitely state that. Please in the event its a Misrep, can it be waived?

Was this a bank account in your name or your uncles? Was the amount in the account changed? If it was an account in your name and it was the amount in the account changed then I think the embassy would have had a reasonable expectation for you to know that the document was forged as you should know how much is in your own account and therefore know if the bank statement being presented was correct or not.
