Good day everyone,

We are having a difficult time getting a drivers license for my now husband. Before his i94 expired we went to apply for a license and we had no problem but unfortunately he didnt pass the test. We went back to retake the test and we were told they couldn't allow him take the test because his 194 had expired and we needed to bring a 797 form to get his 194 extended. We headed back to dmv after we received the notice 797 advising his application is pending but was told that is not sufficient. They are asking for an approval notice. Obviously it is going to take a while for his green card to be approved. Does anyone know what we can do? We live in Nebraska. Thank you.

I haven't checked the NE specifics, but most states require the applicant to wait until they receive an EAD.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You are experiencing the same as most everyone.   Its the law.

This is one of the big perils of the K1. Many choose the K1 because they think it is better to have their loved one here faster but then the loved one is in limbo without being able to work or drive.

 

Some people have had success with going to a separate in-state DMV. If going to a separate DMV does not help then it may just be a waiting game for the green card.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Check the DMV site, EAD is usually required.

This was why we went for a state ID first before a drivers license. She now has a state ID good for several years.  Struggling somewhat with the written part of the DL test.
