I-751 notice of withdrawal

Hello. My apologies if this is the wrong sub-forum.

 

I am preparing a letter to withdraw the I-751. The joint I-751 was mailed In June of 2018 to the California Service Center physical address via UPS. I am trying to figure out where I should mail the I-751 notice of withdrawal. Do I mail it to the California Service Center, as shown on the receipt, or to the Arizona Lockbox, who will then mail it to the California Service Center?

 

Personally, I find it hard to believe the Arizona Lockbox would forward the notice to the CSC. However, I also have my doubts that the CSC will accept direct mail when "Now, petitioners must send Form I-751 to a USCIS Lockbox facility" (per USCIS website). I fear if I include "Attn: I-751" to the CSC address it will be returned or not sent to the pending case file.

 

Your guidance/thoughts are appreciated.

P.S. I've read that I will be lucky if the I-751 notice of withdrawal will ever make it to the pending case file, due to it being "unsolicited correspondence".

Are you the ucs? only the petitioner can do that. If you are getting divorced you can write to let them know it's no longer a joint petition but that's about it.

 

Why withdrawal of the petition?

Once your case is at a service center, you should submit anything related to that case directly to that specific center not thru lockbox. . So you will need to mail to CSC.

It's your spouse's application you can withdraw it. What you are doing is ending your support to the application because the marriage is ending then the application will be denied if the applicant/petitioner does not change it to a waiver or he/she can just file a new one with a waiver. 

You will still be on the hook of the I-864. 

 

You can send it in with the NOA1, A#, names and what else you have on the case to the Service center that is listed on the bottom of the NOA1/Extension letter.

Thanks, arken. It is difficult to make the decision to withdraw the petition, but my spouse is physically, emotionally, mentally, and financially abusive and tells me that I am supposed to do everything "Because you are the American and I am the immigrant". Not a good situation I find myself in.

 

Do you think they will return the mail if I send it to the following physical address via UPS?

Sorry to hear that. If USCIS misplaces the withdrawal letter you can still do the following:

  1. Try to find an option where you can live separately for your own safety.
  2. Cut all direct communication with your spouse. Get a divorce attorney and communicate through your lawyer for your own legal well-being (e.g. frivolous VAWA attempt, etc.).
  3. Gather all the evidence of the abuse, especially the physical, and report it to the police.
  4. If there is an interview then either:
  • Don't show up to the interview. If the I-751 is still joint USCIS will not approve it; OR
  • Show up to the joint interview with a copy of the police report and evidence of the abuse.

I think you are just wasting time/money chasing something that will return you disappointment. Your spouse can/will file by themselves and nothing you do will stop them to get the greencard if they marriage was bonafide. I say go get divorced and move on and find somebody to be happy with and forget the past.
