Timeline

Hi! 

 

We are currently in process of getting a IR-1 visa for me.

I'm Finnish. 

My husband is a us citizen (he also have a Finnish citizenship) .

We have been married for almost 6 years and we are still living in Finland. 

 

The things is.. My husband moved to Finland 2011 and he has NOT been paying or reporting taxes to US ever. 

 

Is this going to be a problem? 

 

We are using a joint sponsor. 

 

05/14/2018 - I-130 sent again to USCIS 
05/23/2018 - recieved
05/29/2018 - accepted and routed to the USCIS Nebraska Service Center for processing

If you filed for spouse visa then you don't do any AOS.

 

And yes, of course it's going to be a problem. Your husband needs to present his US tax returns for your case. It's his duty as US citizen to file taxes... no matter where he live or work.

US citizens need to file taxes on income regardless if it’s from out of the country.

Packet 3 Received : 10/27/14 packet received by petitioner in USA ( beneficiary never received packet 3)

Medical: 10/30/14 Dr. Buteau                  Medical picked up: 11/3/14

Packet 3 Sent : 11/10/13.. Had to schedule interview appointment and attach confirmation receipt to packet

Interview Date : 12/1/14                           Interview Result : Approved !

Visa Received : 12/10/14 picked up at Jacmel location

US Entry : 12/15/14 Fort Lauderdale, Florida

Apply for Social Security Card: 12/30/14 Connecticut

Marriage: 1/26/15

 

Adjustment of Status

Approved: 8/31/15                                     Received: 9/8/15

I found this online:

 

The IRS requires that you file a tax return for every year that you are eligible. Accordingly, you can file as far back in time as you’d like. 

 

SoI guess he will file his taxes then. 

 

And yes, we are applying for: Immigrant visa for a Spouse of a U.S. Citizen 

 

We have to include the Affidavit of Support form with the application to NVC

Of course.

AOS usually means Adjustment of Status, hence why I said it's not something you need.

It means both on this forum so don't worry about it.  It would be nice if we could change the acronym for one or the other but essentially AOS means affidavit of support or adjustment of status.  Generally someone will clarify, but since you will be obtaining a visa, then it's obvious you meant affidavit of support.  :)

And when you see a post in a spouse visa forum, it's prudent to interpret AOS to be Affidavit of Support.  Pay attention.

Unfortunately it's confusing that the 2 share the same acronym...here in the spousal visa forum we refer to Affidavit of Support as AOS. I've referred to it as AOS before myself, but only in the spousal visa forums. So, now that this is cleared up we can get back to the question.
