221 G after K1 Interview in Mumbai

It is a visa refusal under INA 221(g).

Once they complete their processing, the refusal can be overcome. A refusal under 221(g) is the most common refusal for this type of visa...often called a "soft refusal" as it means they either need more documents or to complete internal processing.

I’ll try to lift some spirits. My fiancé just got K1 issued on Monday. 

 

- Aug 9th Interview soft approval from CO but given 221g for not having English translated birth certificate. CO also said not to worry as it will only take 4-5 business days once she submits... yeah right. 

 

- Aug 30th birth certificate dropped off. Took 3 weeks in home town to get birth certificate... long story. 

 

- Sep 2nd - Case Updated moved to non immigrant. 

 

- Sep 3rd -Application Received. No movement for a month. 

 

- Sep 30th, Administrative Processing in morning then Issued later on in the same day. 

 

Currently waiting for update that passport has began shipping. I think it will ship tomorrow b/c passport tracker says it has left the consular office and is being prepared to be shipped.

There is no set time frame or time limit for Administrative Processing (AP).

It's impossible to know unless you get word from the consulate or a refusal letter. Contact them ASAP.

It's not unheard of to see the case status change a couple times as they review the case. So I wouldn't be 100% certain it was actually refused yet...but get in contact and try to get more info.

:crying:  my fiancé checked status today, it says it returned to NVC. Since sep 6 2019 it said refused but on 221(g) it said under admin process, we don't know reason it was refused and when connected consulate few times they said we are working on it you will get email or SMS neither of those happened. I think I am out luck here.

Not sure what to do next get married and file for CR1 or try to contact my local congressman? I am in Indiana. :help:

my fiancé was requested to send back his passport to US Montreal.

But the passport was kept at the interview.

this was asked on January 21, 2020.

please any help is appreciated.

 

what should we do at this point.

Really sorry that this happened.. I’m not any expert but I think marrying & filing CR1 would be your best choice.
