Update: after being in Administrative processing with DS5535 12-18-19: My fiancé had interview and at the interview was told approved, given pink slip. 12-23-19: received email from Montreal for DS-5535. (let c how long this process takes, there is no timeframe per my research, people are waiting from 2 months to years) 1-6-20: Received verification from embassy received DS5535 email from us. 1-7-20 / 1-10-20 / 1-15-20 : case status updated 1-21-20: emailed from embassy to send in passport (which was originally kept at during the interview) 1-27-20: sent in all documents to embassy with letter stating passport was kept after the interview on 12-18-20 1-28-20: embassy received sent documents 1-29-20: email for inquiry sent 1-30-20: case status update 2-3-20: standard response from embassy for inquiry 2-5-20 / 2-10-20: case status updated 2-13-20: status changed to visa issued 2-14-20: passport with issued visa mailed 2-17-20: passport in hand with issued visa 2-19-20: Fiancé entered US through SFO airport (Immigration was completed at the Vancouver international airport - very easy - I94 was issued electronically no fees needed - we printed it as online it only keeps record for 3 months) 2-28-20: religious and court marriage

No 221g given or anything. 12-19-19: Immigrant visa changed to non-immigrant visa. 12-23-19: email received by Montreal for request for DS5535 - Sent back same date. 01-06-20: Inquiry email sent to Montreal by my Fiancé for an update 01-06-20: Email received by Montreal on receiving the DS5535 questionnaire 01-06-20: Email received by Montreal on inquiry sent by Fiancé (response in AP - the standard) 01-06-20: Case status updated assuming due to email's sent by Montreal. 01-07-20: case status updated 01-10-20: case status updated 01-15-20: case status updated 01-21-20: case status updated 01-27-20: Inquiry email sent to Montreal to inquire why are we getting asked for passport when it was kept during interview. 01-21-20: Received email from AIS-USvisa- to submit passport. BUT THE PASSPORT WAS KEPT BY US MONTREAL EMBASSY ON 12/18/19. WE DON'T KNOW WHAT TO DO. THERE IS NO CONTACT NUMBER. WE HAVE EMAILED MONTREAL NO RESPONSE YET. what should we do at this point. PLEASE ANY HELP OR ADVICE IS APPRECIATED. Our wedding date is February 22-2020. I just feel this mess is going to delay the visa even further. thank you

  5. Hello, My fiancé was requested to send back his passport. But the passport was kept at the interview at US Montreal Embassy after being told he is initially approved on Dec 18, 2019. Then on Dec 23, 2020 we were asked for DS5535. New update is to send back his passport this was asked on January 21, 2020. please any help is appreciated. what should we do at this point. thank you

  8. @Jared&Roxy did not get asked because is already a citizen and when you fill out initial application a copy of passport is already sent. I've seen those that are on work permit, study visa, green card holder because with initial application we only send a copy of passport. And if you are not a citizen of Canada, the passport is from your country of citizen and that lets immigration to know to ask for status.

We sent an Inquiry on 01-06-20 midnight Case last update: 01-06-20 - 0600 email they received our DS5535 Case last update: 01-06-20 - 0730 email to our inquiry Case last update: 01-07-20 Case last update: 01-10-20 since then no update on the account.

But did not see any change to CASE LAST UPDATED on below image. I did not even know about DS5535-originally me and my fiancé sent it back thinking we forgot something on DS160. Until I started to research few days later. My fiancé is in Canada on Work Permit, with India Citizenship, education Mechanical Engineering. Just posting here to see if anyone with India citizenship in Montreal Embassy or other US Embassy was given or sent an Email for DS5535. If can share timeline.
