K1 visa interview RFEs (Referral for Evidence) (merged)

Timeline

A family friend was my co/joint sponsor for both the K1 and AOS process and I had no troubles at all. All that was asked was how I knew them. I also didn't make over $10,000 when my (now) wife came over and I'll admit it wasn't easy but we got through it and now have great jobs and are in a much better place. While being financially well off is a wonderful thing, don't let not being rich keep you from being with the one you love. Going through the financial hardship together was way better than being apart. That's just my personal experience though. Good luck!

Sent in I-129F September 14, 2016

Visa received in hand April 6, 2017

I-129F to K1 in hand: 204 days (6 months 23 days)

 

Arrived into the US May 10, 2017

Married June 2, 2017!!

 

AOS

Sent AOS packet January 19, 2018

Greencard received in mail June 14, 2018

AOS to Greencard in hand: 146 days (4 months 26 days)

Because not making enough money or having a qualified joint sponsor can have a visa denied due to possible public charge. 

 

Generally speaking even in Oklahoma where minimum wage is the same as federal wage, he should be earning just over $15k per year working full time.  (It's current income, not w2 amounts that count most in countries like the UK.) 

In Oklahoma you can make a living wage by earning about $10.25 per hour, which is about 125% of the poverty guidelines.

Does the foreign fiancee have to have met the fined co-sponsor? I have never met the man that my fiancee told me about having as our co-sponsor.

No you don’t need to know him.. your fiancé knows him that’s enough 

but at least just his name and what kinda job he does in case but you dont need to meet him

Timeline

Does the co-sponsor have to be able to support the U.S. Citizen as a dependant too? 

Do I have to support evidence of why my fiancee hasn't filed taxes or are they just interested in what the co-sponsor can offer?

Are they going to have a predjudice against us because we met on a dating website?

Did you have to provide evidence of why you used a joint sponsor and why you didn't meet the income requirement? Did you have to provide your tax returns anyway?

 I didn't meet the requirements because I was in school full time and only had a part time job. They didn't ask about it to my knowledge, but I did include my transcripts to show full time enrollment. I also had all tax returns and other financial proof.

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
