We are k1.  Fiancé arrived December 23 2018.  We could not get a wedding date at the courthouse until February 23 2019 to get married.  Is this too late to get married given that we only have 90 days to get married and do adjustments of status?

You have 90 days to get married.

 

Adjustment of status can be filed outside the 90 days.

1.  Marry within 90 days of entry to US.

2.  File AOS afterwards......once AOS is filed, the new spouse will be granted authorized stay while the I-485 is pending.......don't worry.

Go to another state and get married or even another county. We married the next day my wife (now ) got to the USA. Filed in the same week also and didn't wait to file for AOS and SS#, because of some lengthy wait times to get AOS approved.

10/21/2018                Card was mailed to me, and yes it said so on a Sunday night, while Vj-ing

10/24/2018                EAD in hand. F%^&& finally

12/28/2018                Interview has been scheduled. Waiting for notification with date by snail mail

February 23rd is long before 90 days are up, so you're fine. AOS can be done after the 90 day mark (although it is not advised since your fiance will be out of status from day 91 until USCIS receives the AOS application). 

 

 


Removing Conditions Timeline

Aug. 10, '17: Mailed in I-751

Aug. 21, '17: NOA1

October 23, '18: NOA2- approval

October 30, 18: 10-year GC received

if POE was Dec 23, 2018, then you have until March 23, 2019 to get married. Feb 23 is fine, though if you want to start AOS or otherwise want to get married ASAP (which you may for a lot of reasons), you should look at other county clerk's offices (maybe in neighboring counties) or even heading to Vegas.

go to a different court in a different county, I wouldn't wait that long. but either way, you can file AOS after your 90 days are up

If you want to get married sooner, try a self uniting marriage. My husband and I have done that (Pennsylvania) and it's also legal in Colorado and in some cases in California. If you can't do it in Cali and are close enough to Colorado, you could look into it
