I can only assume you will have questions as you go along. Many of our answers are predicated on the information you supply in your profile. When we look at the left column and can't determine your timeline or your Embassy it's hard for us to give you a factual answer. Hello everyone,

 

In case you haven't notice yet, processing times have gone back from 5.5 - 7.5 months to 5 - 7 as it was when I filed back in april. Good news for new filers.

My beloved and I filed on  Oct. 29th 2018. I found this group and realized someone else had filed on the same date (I wasn't sure if ai should be in a November group that is). Petition was delivered on Nov. 1st 2018 to Lewisville, TX. We are waiting on a response/notification. I look fwd to sharing and learning here. All the best to everyone on their journey.

Update: Our NOA 1 or I797C was a Rejection Notice...outlined use of an outdated form version of form I129F as reason. The older form has 6pages the newer one has 13. We have a correspondence to use on the cover of the resubmission. We will resubmit this next week (FedEx etc. between countries included). It was an oversight that but we ended up laughing about the mishap and the returned package. (My finance is upser her binder aand plastic sleeves were not returned more than the rejection notice. All in all, we are still on pace with our estimated time for approval for a June 2019 Wedding. ☺

How did you end up using the wrong form?  The one on the USCIS website has been the same for years.

 

Also, June 2019 is very optimistic 

 

Edit: please update your timeline to show these new dates. You have your NOA1 date as 11/06, this is incorrect and won’t help us provide correct information

This is all very unfortunate as it's likely delayed everything by around a month.

Preparation is key. We will remain cautiously optimistc. I think, however, your approximation may include the EAD? August is a stretch, at best. The file has been accepted, scanned and recorded with the exception of the wrong I129F form, it will all be sent back "as is" with the correct version form. 

Looking at other timelines with similar issues gives us reassurance that the delay puts us back perhaps 2 weeks at most (hopefully not at all as I send out my signed forms to my fiance tomorrow). She will have them Tuesday   and will overnight them Wednesday the latest (considering the holiday - Happy Veterans Day BTW Everyone) after signing.

So even if we get an NOA 1 - say- by month's end, I anticipate an interview and visa in hand by late May 2019. My local Embassy issues visas (once approved) same day (depending on appointment time - am/pm) or next. Not very long after that for certain.

Even still....the timing doesn't bother us we have lots of vacation time. I joined this site to help guide us along the process and learn from/share experiences.

Hi. So here's our timeline for K-1 Visa:

-Oct 20 2018, packet sent

-Oct 24 2018, check was cashed out.

 

But until now, we haven't heard or received anything yet :( We didn't fill out the e-notif form so we won't get any text or e-mail from them. Is that normal? Can someone tell me what to do? 

 

Calling to USCIS for inquiry requires the Case num which we don't have yet. :(

Give it a few more days to see if you receive the NOA by mail. Sign up for Informed Delivery by usps so you’ll see if you’re expecting any mail.

 

The fact they cashed the check means it’s all okay. Admittedly, this is a lot longer than normal for receiving the NOA1.

 

Calling USCIS should not require a case number, just press 0 a bunch of times and you’ll be put through to someone. I think they ask that you give them 31 days from the date the tracking shows it arrived.

Hi. Okay I'll give it a few more days. what do you mean it's okay that they cashed it out? Is it possible that they're processing it or there's still a chance that they'll regret it? I read somewhere that starting Sept 12 2018 they will no longer give out RFEs and can instantly reject or deny an application. Are you familiar with that?

  1. If the check has been cashed by USCIS, then they have accepted your petition and have started processing on it (this takes 6.5 - 7.5 months currently).
  2. They are processing it, if they had already rejected your application you would have received a rejection notice via mail.
  3. I have no idea about this, I don't think that's entirely accurate. Their website states that the USCIS Adjudicator can deny it without asking for more evidence, but for an Alien Fiancé visa I doubt they would do this. I may be wrong, but I think some people have recently posted about a RFE. You wouldn't get an RFE this early anyway, so this is definitely not the issue.

 

In the mean time, check the details on your application are correct. Check the mailing address you supplied for the USC.
