I-797 Rejection Notice - Need Help

Timeline

I applied for adjustment of Status  I-485 and the entire package was returned or rejected for the following reason. 

Based on the information provided, your priority date could not be established. Please resubmit your application with the proper documentation to the address listed on the bottom of this notice.  

That I-797 was stapled on I-485.

 

A second I-797 stapled on I-130 that was also rejected for the following reason.

Your -130 form is being returned to you because the eligibility you filed under requires that you file an I-485 also. Please resubmit both forms and the appropriate fees in order to continue processing.   

 

A third I-797 that is stapled to form I-131 that was returned for the following reason.

The Principal application could not be accepted for the reason specified on the related Notice of Action (Form I-797) therefore the processing of all riding applications can not continue. 

 

A fourth I-797 that says.

The application petition was filed on an outdated version of this form. please resubmit your application with the proper documentation tp the address listed on he bottom of this notice.

I assume you mean AOS from k1 visa? Did you marry within 90 days? If yes, then you don't file i130. 

 

The last one sounds like you used old forms. You need to get current forms from USCIS website. 

K1

29.11.2013 - NoA1

06.02.2014 - NoA2

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

Sounds like you may have submitted incorrect or unnecessary forms, as the 130 shouldn't be needed if you are applying for Adjustment of Status along with your EAD (work permit) and AP (travel permit) applications. Were you a K1? 130 is definitely not needed, if so.

 

And the last one - you used an outdated form. Make sure you use all up to date forms, which can be found on the USCIS website (.gov).

 

Just correct the things it was sent back for, and resend correctly.

As others mentioned, what are you adjusting status from? Tourist visa? K-1 visa?

 

This is crucial to know the appropriate paperwork and fees.

Yes, a K1 visa and Yes, we get married within 90 days, but in all the information that I look for, it tells me that I have to fill out form I-130.

 

I Noticed  that in the I-864 form I use an old version I'm solving that right now

Another question I am applying for  my wife with her son, each of them needs an i-864 form ?

You've been using wrong guides then. This is the one for K-1 AOS applicants:

Now I'm more confused, because from the beginning I was told that I had to fill out the I-130 form for each of the beneficiaries with a money order for each of $ 535.00 and im prety sure  USCIS cash out those money order

The line above implies they rejected all the forms, in which case the payment should have been returned.

The $535 fees are for the I-130s, which as noted above, you don't need to AOS from a K-1 when married within the 90 days of POE.

Looking for information on the USCIS website I found this for the requirements of an AOS
Copy of approved Form I-130 or I-797, or Notice of Action if Form I-130 is pending (if you have a K-3 or K-4 visa)

My wife came to the United States with a K1 visa as a fiancee and her son came with her and we got married within 90 days. What you are informing me about the I-130 that I do not need is true in my case

However, to avoid questions related to the eligibility or age of a K-2 stepchild, Form I-130, Petition for a Foreign Relative must be submitted on behalf of the stepchild of the person with a K-2 visa. For more information, see "Other considerations."

She came on a K-1 and the child on a K-2, so the lines above referring to an I-130 for a K-3/K-4 does not pertain to your case.

Follow the guides linked above. They cover AOS from K-1.

I'm not sure what you are quoting from. A K-2 AOS applicant does not need an I-130 (unless the marriage was after 90 days, again).
