It doesn't mean they are suspected of anything...just that they have been selected (random or due to specific circumstances like travel history, nature of work, etc.) for additional security checks involving their residence and work history, social media accounts, and other criteria.

The refusal letter would state that the visa is refused AND the underlying I-130 petition is being sent back to USCIS with a recommendation to revoke it. USCIS will then review the case and either reaffirm it or issue a NOIR. This process can take anywhere from a couple to several months. The NOIR has 30 days for a response. Upon receiving the response, USICS will either reaffirm the petition or deny it. If reaffirmed, the petition is sent back to NVC and then the embassy for a new interview. The embassy is not supposed to deny the visa for the same reason.

 

NOTE: trhe above does not apply to a refused K-1. Despite what some refusal letters say, a returned I-129F is not reviewed by USCIS and left to expire. No NOIR will be issued under current policy.

Not really insider...just aware of policy changes that have come around over the years.

Off-topic: The reason an I-129F is not reviewed is because it sets a P6C1 (fraud) marker, which could turn into a fraud finding (and subsequent inadmissibility) on a future re-petition. Instead, they let it expire and you can re-petition (either for another K-1 or marry and do a CR-1).

PErhaps it was a job position. What do you and your fiancé do for a living? Maybe you traveled to certain countries that they are concerned about also. It shouldn’t take more than 3 months. Hopefully you’ll hear something soon!!

They wanted the co-sponsoring sheet filled out and proof of domicile for my husband. 

He's been living in Lebanon with me for the past year so they wanted to make sure he'll be returning with me at the same time.

 

I sent the documents 2 days after the interview and now my favorite hobby is to check the case status every day

 

Our plan was to be in the US Nov. 1 which doesn't seem like it's happening at this rate.

Anything yet? I'm sorry you had to go through that 😕 I'm not so knowledgeable about i130s but maybe the 8 months he took off could have raised some questions about finances etc. I hope you hear something soon.

The issue is with background checks (as evidenced by the DS-5535 being requested) , not anything to do with being a public charge.

I meant that maybe that was what raised the need for additional background checks. If there were no assets presented and he was able to fund his travel for 8 months etc since thats one of the things they as for in the form. Just a thought but thanks for the clarification 🙂
