Frustrating isn’t it.   Im getting a joint sponsor and sending it’s respective supporting documents and im sending from my husbands tax return, transcript and w2’s

#######. Just received an RFE.

They're asking for my husbands full tax return of the last tax year. I submitted the same documents I submitted at the embassy and now it's not good enough? Not sure what all to send in, the tax package is a thumb thick file. I had send in the W2's and the 1099 forms.

Get the tax return transcript from IRS, not return but transcript and try sending that. 

 

What did you send for taxes?

 

Only w2 and 1099? Cause if you send these 2 then you need the tax return at least and that would be a lot of pages.

 

if you send the tax return transcript obtained from irs then you won’t need these.

 

your husband can obtain it online or ask for it to be mailed to your address (takes around 4-10 days) for free.

 

good luck! And don’t forget to send the copy and not original because they may not scan the back of it!

That's bogus, if you don't mind me asking, what is your yearly income(before taxes) and are you sure maybe you didn't forget W2 form or something that goes with it? i'm just curious how you ended with it.

Hi! 

 

I've been lurking on this board and wanted to share my experience! I got married in May, and filed everything Aug 8. (Now I'm mad at myself for not filing earlier, given the current wait times!)

 

I got my biometics appt in the mail sometime in the second last week of August, and did my biometrics Sep 6. As of Sep 12th, it says they are ready to schedule my interview. 

 

Now, I guess it is the waiting game. So far, so good it seems? Best case scenario, when do we think we could receive our EADs? I hope it is not as long as everyone is saying- minimum 4 months?

I got the same RFE... and we are not the only ones. After some research, there seems to be something in common… the damn full tax return (or according to them, an incomplete one). They clearly prefer the IRS transcript, if they get too stressed looking at that pile of paper, don't find or understand something, they just send the RFE. Did you also get that generic RFE stating that your spouse's income doesn't meet the 125%, even though it does?

The EAD is currently taking 4-6 months. I'd be happy if I got it in 4 months...

Of course I'd be happy if I got it in 4 months. It just used to be minimum 3 months from the date you filed I think, but obviously it's just taking a little longer. I just want to be able to get back to work! 

 

Would the EAD come before the interview is scheduled? I'm seeing mixed things online.

Yeah it's annoying to be in this situation, it just shouldn't take this long.

 

I think the interview is usually scheduled before the EAD comes, but I guess there are also cases in which they take longer to schedule it. I'm not completely sure though

This is ridiculous. I didn't send in the whole pile, just the W2 and the form 1099 things (which were satisfactory for the embassy).

There was no mention of not meeting the poverty line (which my husband is way above too)

I only sent the w2s and form 1099 as that's what I found online was what they'd want to see. We requested the bare tax return from our tax preparer and instead of the solid pound of paper we got 13 pages of bare tax return forms.

 

The rfe literally says: sponsor must submit a complete federal income tax return as submitted to the IRS.

Get the tax return transcripts, they are usually shorter than returns itself (not always though) and the finalized version. Which I the proof of what you submitted to IRS, it’s like the receipt. 

 

This rfe is showingup everywhere don’t stress yourself just send them what they want, even though it’s ridiculous...

 

 

edit: so you didn’t send any tax return?  that was in the form instructions to send, at least the most recent years. Return + w2/1099 or tax return transcript.

Yes, it asked for a transcript of the tax return. But the tax return was over 100 pages. So I googled what pages were actually needed and it came back saying  they only need the w2s and 1099 form as that is what proves your taxable income. Apparently that was not enough.

I think we now got the transcript cause what we got from the tax preparer now is only 13 pages.

Got everything ready and will send back today. 

 

Do you think this means they're actively working on my case? With the k1 they only started doing rfe just before approval. According to the average green card processing times I still have 8 to 10 months to go?

In AOS, they send RFE's as soon as it comes out. Waiting is usually after it turns to "Interview ready to be scheduled" Which is the wait for the backlog of your local office and most RFEs come before that. So after this clears it usually is clear :D 

 

I am not sure what the difference between the papers from tax preparer and IRS, but I would look into it just to avoid any other RFE. I only sent what IRS sent us. (Unfortunately this is also as vague as anything about the process is 🤷‍♀️)
