Brand New to the Process! Residency help?

Hi amazing community!

My husband came here on a K-1 in October 2014. He received his 2 year GC in Sept. 2015.  We've been waiting on his 10 year GC since July 2017--no movement yet. Everyone on the July 2017 thread says things are massively backed up. 

 

HOWEVER! We are looking ahead to citizenship. It is my understanding that we CAN apply for citizenship, even if his 10 year GC is still in processing, yes?

 

If this is the case, the part I'm struggling with is that we JUST moved to ND from MN last week.  Our residency is still in Minnesota; and since we're living in Fargo, just across the river from Minnesota, we don't intend to change our residency to North Dakota any time soon ( we may end up buying a house in Moorhead, MN).  At the moment, we are renting a place in Fargo, North Dakota.  Does this bar us from applying for citizenship because we haven't lived in ND for three months yet?

His extension for his 2 year GC expires in September, so I'm hoping we don't  have to wait to apply for Citizenship. Any thoughts or advice you have would be so helpful!

Correct. You can apply under the 3 year rule while your ROC is still processing, assuming you meet the requirements. You can file up to 90 days early, actually.

 

As for the residency issue, what do you mean "we JUST moved to ND from MN last week"? Either you moved or you didn't. You can temporarily visit another place, but it sounds like you actually moved and are living in ND now.

I have seen on other threads for filing N400 that some posters were denied for not having a 3-month presence in the state they were at the time of filing. Also, you have to inform USCIS about change of address within 10 days of moving to your new location by using AR-11 form.

That doesn't make sense.  You reside in ND after your move to ND, therefore, your residency is North Dakota......Normally (except in the military), you can't just pick a state for residency....or am I missing something?

 

EDIT: By most state laws, you are required to change DL addresses,  Change car registrations, etc within a number of days after moving......and you certainly must notify USCIS.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I don't have an answer for your question, but just wanted to say hello, I'm in Fargo as well. My fiancé and I are waiting on our second notice for our K1 and will hopefully hear soon. Good to see someone else on here from ND :)

Oo! Thanks all. I guess I didn't think it through that way.  I wasn't sure we had to change our residency right away if we moved because lots of people from MN live in Fargo and keep their Minnesota plates and driver's licenses. I already filed the AR-11 when we moved, so that is taken care of. So what I'm hearing ya'll say is we need to:

1. Change our address on EVERYTHING and our residency to reflect our move to North Dakota

2. Wait three months to be eligible for citizenship.

Ran into your post while looking for others in the Minneapolis Field Office jurisdiction. I would refer to the instructions and the USCIS policy manual. Sure, you moved to ND. However, your USCIS district/Field Office/jurisdiction did not change. So if anything, you're just lucky that your jurisdiction covers more than one state. See for yourself. Always refer to the instructions as much as you can. Otherwise, you may just be misinformed.
