Hi guys,

 

So i made it to the US and am now a happily married man :D 

 

I have all my change of status papers and am just about ready to send them off, but i am wondering about the EAD situation

I get that i have to send off the i-765 so that i can work, but what happens next? Do they send me something or is it ok to go looking for work right away?

Obviously i'd like to get started but i want to make sure i'm doing it by the book

You cannot start working until you have your Work Permit in hand.

 

Once you file AoS and all additional paperworks, you should receive your work permit in about 3 to 6 months. Waiting time is pretty long at the moment.

K1

29.11.2013 - NoA1

06.02.2014 - NoA2

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

I agree with above.  You can't legally work until your EAD is approved.  Unfortunately, that is one of the downsides with a K-1 visa vs CR-1.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

one of my regrets was that i did not start looking for work way before i got my ead. i got my ead last jan and here i am 4 months later still looking! depending on where you are, the job hunting process can take a while. so if i were you, i'd start looking for work now but make sure that you do not misrepresent your status (ie that you have applied for but still waiting for you ead). you may get lucky and may find an employer that do not mind waiting or better yet, they may be able to give you an offer which you can use to try to get your EAD expedited!

You can request an expedite. Whether or not they grant it and how long it takes is in their hands. Currently, even those with a job offer are often taking quite some time. But yes, having a solid job offer is a reason to request the expedite of the EAD.

 

You can look for work and apply sooner. Whether or not the employer will wait the remaining 3-6 months is a decision they will need to make.
