Timeline

Thank you all for your mostly kind thoughts and suggestions.  I just got off the phone and got her timeline history: It is indeed complicated - she had a Visa that was going to expire. She applied for an extension which was denied. Hope things would be okay with the extension she didn't pay attention to the fact the time passed and the denial came 4 months after her visa expired.  She then got married, and her new husband gave the 'paperwork' to his cousin help with.  He didn't. 5 years later, in 2011 she filed for divorce, and returned to Thailand to visit her family.  Please, no criticism folks.  Some people are just very trusting of others. She trusted the wrong people.  I've know her before she first came over with her Thai b/f and now after all these years we have fallen in love.  So, as of tonight, my plan is go there and get married in Bangkok.  Then, we'll see what happens next.  And I really don't want to live in Thailand - first I recently adopted a Samoyed puppy and I'm not going to give him up.  And I prefer living in a colder climate.  I enjoy traveling in Asia, but no thanks. I'll live in California.  Next step - speak to an Attorney, I presume.

Timeline

Spouse Petition and a Waiver would be say 2 ish years and she has 4 years left on her ban. So that would be quicker.

That's quite a history.  Make sure all that is recorded accurately when you apply for her spousal visa.  Good luck...

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Chiang Mai is quite cool to live in, like San Francisco.

 

And of all the countries.. Thailand ranks among the best and easiest to get a spousal visa.

 

You might wanna consider moving to Asia and samoyeds have no problems in Thailand. I know this because my mother in law owns 2 that we gave her along with a husky for my sister in law.

 

Anyways up to you what you want to do but just like you.. I lived overseas with my significant other for years till DOMA decision changed our lives and I could apply for a K-1.

I-485 Mailed: June 20, 2014 | NPIW: October 15, 2014 | Welcome Letter: June 23, 2015

I-751 Mailed: March 20, 2017 | Approval Letter: February 24, 2018

10 YR GREEN CARD IN HAND: March 23, 2018

N-400 Filed Online: March 20, 2018

An attorney can help you with any info you need on any appropriate waiver recommended by a CO.

An attorney cannot change immigration law.  She must wait out the rest of the ban in her home country before applying.

Assuming a successful waiver, yes.  With not severe hardship to the USC, there will be no successful waiver.  I'm assuming nothing and concluding, based on the facts, what the outcome of such an attempt will actually be.

Facts are cheap...knowing how to use them is precious...

why did you refer to her as your dear friend? I hope you aren't trying to "help" your friend get back to the US by marrying her. You didn't refer to her as your girlfriend and that you have been visiting her as her boyfriend.

 

 

 

 

I believe once they start the process , they will get into a strict investigations and lots of evidences due to her friend's or girlfriend's past story.

 

I think their case during processing will be much more difficult than any other's cases.

Sure, but "done correctly" has to include a legitimate justification.  Certainly worth a consultation with a qualified family immigration attorney with waiver experience.

OP has mentioned a couple of things in this thread, basically a tick box exercise. I see no issue, just time and money as I doubt from his Posts he would be best advised to do it himself.
