back story

 

immigration application approved in 2009 - got call for interview in 2014
Family of 8  Two parents > 6 kids >
my sister got married in 2006, and my dad never revealed this info thus visa cancelled  INA Act section 212 (a)(6)(C)(i) Material misrepresentation.
Went for  interview the interviewer asked us just few questions like what we all siblings do study or job just that and congratulated us. After two days we got our passports with visa on it.
But later the embassy came to know about the above said wrongdoings, and asked via call to submit back our passports (because of technical fault) after submitting the passports back they contacted us again where the counselor on phone said "you are unlawfully taking your married child in to united states" and asked us to appear in person in Islamabad embassy where the interviewer/counselor questioned "why we failed to reveal this information and further told that my sister cannot immigrate to united states with us  but have to apply for herself separately and since You (my dad) were concealing this information and will fully misrepresenting so we (embassy) are cancelling your visa but are sympathetic towards your children they will not be debarred from entering united states."  

 - my parents don't speak English so they were being assisted by translator.

as the interview finished the counselor handed back passports and 2 papers 1 to my dad and 1 to my sister.
in the dad's one there was check at  NOT eligible to seek waiver  -    212 (a)(6)(C)(i) Material misrepresentation.
and in the other there check at Eligible to seek waiver     -      212 (a)(6)(C)(i) Material misrepresentation.
On the all passport they stamped  Cancelled without prejudice
after some 1 year from the cancellation date my dad sent appeal to embassy to reconsider the immigration case but they declined to.

Now my question , is there anyway i can convince the embassy to reinstate  immigration application for the rest applicant. or for me?
 at the ceac status website it still show my status as ready. and my dad's at administrative processing  ( see attachments)
My dad the main applicant and his brother the sponsor (my uncle now deceased)

Time to say goodbye to the US. 

 

Face the consequences of lying.  Embassy won't forget about your misrep just because you ask nicely.

Learning the hard way the consequences of lying on an immigration application. Plus as others have said not only did the petition died with the petitioner, but the principle beneficiary- your father - is ineligible. There can’t be any derivatives if there isn’t a valid/eligible beneficiary.  You need two working links in the chain for you to be able to migrate, and both of them have been broken.

 

the only confusing thing about all this is why no one has updated the CEAC status to show refused on all, it’s clearly just been left on whatever the last decision was. That blurb about AP is the standard blurb that gets put up for all visas after interview but before a final decision is recorded, don’t read anything into it.

? Your uncle daughter sponsored your father? How does this even work. 

 

Anyway. What's done is done. Don't get your hopes up.

Nor can cousins sponsor other cousins.

Was the consulate made aware of the uncle dying?

It doesn't matter. You all have misrep. Your father is forever banned from the US and you can only immigrate with him. There is no way for you to receive this immigrant visa.
