Hello all, I haven't been on in a while so apologies if someone has already posted this same question or similar.

We filed the I-485 and then sent the I-131 and I-765 separately a little later. All were accepted, got the email/text, cheque cashed, and NOA1s received. Then, we got an RFIE (Request For Initial Evidence) in the mail stating that my birth certificate was insufficient and they need further evidence of my place of birth and my parents names.

The birth certificate that I submitted has all that information, it is a long form birth certificate from the province of Ontario, Canada - there shouldn't be any reason it wouldn't be enough. Anybody have any feedback or has anyone else got this? I am going to send the actual document rather than a copy so they can see the seal, as well as my short-form card size bc which I sent when we did the K-1. It was accepted then, but it doesn't even have my parents names on it, whereas the long form has all that. Also trying to get my record of birth from the hospital I was born at but it will take a few weeks to get and we're losing valuable time by doing so... appreciate any information on this issue.

and this is the acceptable birth certificate for my province:

Ontario: Applicants should obtain "large" certificates or certified copies of a registration from the Office of the Registrar General in Toronto (Macdonald Block, 900 Bay Street, second floor, tel: 416-325-8305) or at Ontario Land Registry Offices and Government Information Centers located throughout the province. Further information, including locations and information on ordering by mail is available online.

 

That is exactly the birth certificate I have and sent a copy of, because I ordered it from the Registrar last year for the purpose of immigration, from the same website that is provided here on this US gov site.

Is the RFE for the I-485?  If so, then yes the Marriage Certificate needs to be certified.  For the I-765 and I-131 it does not.

I hope I don't get an RFE since I submitted regular copies of everything, I indicated in my cover letter that they were true and unaltered true copies of original documents. 

 

I followed the instructions from USCIS website.

Same here, @Eros99! We sent regular copies. There were people who just sent regular copies and they were fine. Let's cross fingers!

Hmmm, are you sure you sent a copy of your marriage certificate and not the marriage license? The certificate is usually mailed 4 weeks+ from the date of marriage.

I read in another thread that this is a mistake some people make especially because depending on the state, the marriage certificate is just a "souvenir" and it doesn't have any value, while the marriage license does. At least that's what happens in AZ. For that reason I sent our marriage license with the stamp from the county.

It is confusing.

We were married in CA. We had to register for a license before we could schedule a wedding, and that license was the one that the judge signed right after the ceremony, so I assumed that wasn't the document needed for AOS.

 

I was told that the certificate you receive after a month or so is what's required because your marriage isn't registered the day of the ceremony, but I also read that it's just a souvenir. I remember being asked if I wanted a certified copy during registration, though. We even paid for it. I assumed that that was the certificate we received a month later. So yeah, CONFUSING.

 

But anyway, to be safe, I sent both the signed license and the certificate.

Submitted the form for the text/email notifications and never got any. It was the wrong amount on the bank check so we got our RFE today for AP and I-485 for that. No news yet on the EAD.

We got married in a county here in Georgia and our marriage license was collected by the Judge who told us to expect a certificate in 10days. We sent the regular certificate to USCIS without being certifying it. We only got an Rfe for i-864, which means the other Documents are fine. "my view tho"

It's crazy how every state is different! we got married at the city hall and got 4 certified copies at the end of the ceremony which was prepared before when we applied for the license. We also got one certificate the same day as a souvenir for framing.

I think it goes by state, no? When we got married we applied for marriage license and had to wait couple of days to pick it up and it came in an envelope saying marriage certificate, the certificate itself had a county seal there was another paper that we signed and left it with the person who officiated the wedding.
