January 2018 AOS Filers

I was hoping to get an advice on this.

My dad was petitioned for (I-130) and was approved back in 2010 by his brother who is a U.S. citizen.

My siblings were included on that application (I-130) as his derivative beneficiaries.

The application is at the stage of waiting for visa to become available (current priority date is 2006; so, at least 12 years off based on the approved I-130)

 

I became a U.S citizen and now want to file directly for him as immediate relative.

Is there a way to upgrade the previous I-130 (filed by his brother) based on the new petition I filed for him such that my siblings could still be derivative beneficiaries?

 

The reason I'm asking this is because I read that you cannot qualify as a derivative beneficiary if the application is based on a filing by an immediate relative. So, although my filing for him would make him eligible for faster visa, his children (my siblings) would not qualify to join him on that petition. I'm looking for a way to help them join him without filing individual I-130's for the siblings.

 

Does this make sense and can anyone please help advise? Thank you all.

I was curious if anyone knew of a protocol to follow if the US citizen spouse cannot attend the interview? Going off VJ dates it may be done by September but in the case that it's not, he won't be here.

Would I attend the interview alone and explain the situation...Would I have to push back the interview (potentially for 6 months)... Or is there some kind of waiver I would have to file to avoid an interview?

You should attend the interview make sure u take his military deployment orders with u and explain the situation to them. My husband may be deployed in Sept as well and if we don't get an interview date by then that's what I'll do!

Hey everyone!

 

This is a great thread.  I filed our AOS application on the 26th of January and it was received at the Chicago lockbox on the 28th.  We just received the texts and e-mails (all of them) last night around 11:30pm EST.  I was wondering if others hear could chime in with about how long it took for your checks to be cashed.  I'm a little worried about our check being cashed.  It's a cashier's check and I accidentally endorsed it.  My bank told me it would be alright but I've read on other VJ forums that the check probably won't be cashed and I'll need to send a new one.  Luckily I already asked my bank about it and they said that all I'd have to do is come get another one so I wouldn't have to wait at all (which does make me feel a bit better).

We did not include any medical documents as I was not given any (except for the vaccination sheet, which we did not include though) and we read if the medical took place within a year from filing, this is fine for K1. Can anyone here confirm or should we have sent something?

You're right that if the medical done abroad was completed within a year of filing for AOS then you will not have to have another medical.

 

If you're vaccinations were complete then you did not have to fill out the I-693 and go to a US civil surgeon as well.  I would have included a copy of the vaccination document but I'm not sure it's a big deal.  We needed to have our vaccinations completed so we had to go to a civil surgeon and have the I-693 vaccination section filled out (which was just waiting around the doctor's office until the paperwork had been filled out since we got the vaccinations done at our county health department).

Not entirely sure but I think one of the requirements listed on the I-485 form is the medical document. If you did your medical exam before you flew to the US then yes, you should only have the vaccination record, and that is what you're expected to send. I have a friend who didn't include her vaccination record in her packet and she didn't encounter any problems. She was asked for it during her interview, though. 

 

Worst thing that can happen is you get an RFE for it which will delay the process, but your application should not get rejected for this reason alone. If you don't get an RFE, just make sure you bring it to your interview because they will ask for it.

 

If your medical record was more than a year old when you submitted your application, they will ask you to get a medical exam again, so I suggest you get it done before your interview schedule to avoid any delays (assuming you don't get an RFE for it). Good luck!

The medical was in November, so no additional one needed. I also got all my vaccinations done abroad, so I will bring the vaccination record to the interview and hopefully I won't get an RFE and all goes smoothly with no RFE.

Does the cashier's check have your name on it? I forgot to sign one of my cashier's check and they never returned it. It had my name and account number

I don't think it does.  I'm just keeping my fingers crossed.  Hopefully they realize it's my signature but I guess I shouldn't confide in them so much after reading so many goof-ups on their part.  I'm glad it went well for you though.  I'm going to call my bank tomorrow to see if the check has been cashed.

Appointment scheduled for Feb 9th, I went for it on Jan 29th.

Also, the National Benefit Center is not at Baltimore, if your case number starts with MSC then your case is at the NBC in Missouri. The field office is located at Baltimore. Just give it some more few days. your biometrics appointment notice should arrive

I am in process of filling my package but I was wondering if I should wait until after 3/6/18 to file the edition 12/13/17. However I want to wish everyone a successful year in their filing and god is gonna take us through. Question should I or can I wait to file the i-693 medical form? Would it stall the process ?

Did biometrics drop-in in Seattle on Monday morning. My appointment was scheduled for Feb 13, so I got in more than a week ahead of time. They were really nice, and I didn't have to wait at all. I just went in with all the people who had appointments.
