Hi All,

After 9 months of waiting and wondering, we thought we finally reached the finish line with our K1 visa process, to our complete shock, we were put on AP, despite having everything that was asked of us, all the required documents, tons of pages of texts, viber logs, facebook messenger logs, whatsapp logs, pictures, anything and everything. Most of those put on AP out of Cairo have been on AP for months with no end in sight. I dont know what we should do at this point? Anyone been in this situation?

Everyone goes through AP. It's either short or long depending on your case.

Were you told that you'll be put in AP at the end of the interview or you saw your status on the NVC CEAC tracker? Did they ask you to complete the DS-5535?

Any red flags in your relationship? Age gap? Different religion? Fast engagement? Only met in person once?

For my I-129F, K-1, AOS, EAD, AP and ROC detailed timelines, please refer to my timeline page :)

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

My sincerest gratitude to all VJers, especially the late geowrian.

There is nothing you can do at this point. You just have to be patient.  It could be a long wait.....or a short one...

He didnt tell my fiance AP specifically and he didnt take his passport. He gave him the white slip and checked off evidence and passport, which we didnt understand because my fiance had tons of evidence and had his passport on him. All he told my fiance is that they would review his documentation and make a determination. We have no age gap, we are the same religion, we are both ethnically Egyptian, I was just raised in the US and he was raised in Egypt. We met in person twice for 10 days each visit. No red flags at all.

We are unsure if we want to wait indefinitely, since that seems to be what is happening with those on AP in Cairo. We are debating whether to get married and Ill move abroad and we can apply for the marriage visa.

Hi

This must be very frustrating. However, please understand that the AP process is due to many reasons and does not indicate a problem unless there is an evidence for one. My parent who is 65 went on AP for 4 months simply because his name was like one they are looking for. So in short, AP can be either for extra security checks, or verifying all the paperwork related to your case. whatever the reason, they will give him the passport back in case the applicant needed it for any reason, and they did that with my dad. So try to calm yourself and cheer, you will hopefully hear good news very soon :)

Good luck

Ah, I also wanted to add that getting married will not resolve the AP. Living abroad can help lessening the stress of being a part for sure, but then you will go through the process of submitting i-130 and all that fun stuff which takes currently around 9-12 months processing and still, he could be placed on AP. I am from Egypt and has my handful experience with the embassy there.

Will keep you in my prayers.

Thank you. I think we are ok with it taking time because we will be together and will work until we are able to come back to the US together. This isnt for sure the route we want to take but we have already been waiting for a very long time, our NOA2 took 8 months to come. We have only been reading negative experiences with being on AP out of Cairo, people have been waiting for 9 to 10 months and still havent heard anything from the embassy or given any guidance at all, we dont want to wait that long.

I don't blame you. I have been away from my wife for only 10 days now, and it is driving us nut. I am just trying to share with you that it happens especially if his name is very common. But yeah, if you can be with him, go for it :)

So I was married once and I moved to the US  with my then-1st wife. We stayed together for like 6 years and we came to an agreement that we cant continue, so we peacefully agreed to move on and we are still friends. For that marriage, my interview was in 2009 and she was with me during the interview. We did not have any issues and visa got approved on the spot and received it 3 days after through DHL. Now, I am married to a Moroccan girl, and submitted her I-130. Yes I did the marriage visa in both.

Hi no_where_man,

we have been on AP for 3 and half month. my fiance went to the interview back on June 6th and she was handed the passport and a white paper asking for family registration and viber history but he didn't tell her the case will be under AP. we sent them and the embassy received them on June 12. from your experience how long does it take to hear back from them after receiving the documents? when the CO ask for additional docs does the case usually go under AP or is AP only if it's security check?

thank you.

AP can be for various reasons. One of them is security concerns, investigating validity of a relationship (as it is in your case apparently), or if they are waiting for required documents. It has been over 3 months since you submitted the requested documents. Definitely, you will need to email the embassy and request an update on the case.
