Quite common in some countries for people to forget they are married as it puts them into a longer category or out of contention.

 

Wonder if he divorced.

i dont know really the whole story. because i think she prefer it to be their privacy.. but yeah, she said  he's divorced already..

I think we need more information.

 

If he got married/divorced in his home country then they might not find out because his background check will be focused on his life in the US. However, they might pull up his previous visa application and find out he was married/divorced and that now he is claiming he was never married.

 

I would consult a lawyer because maybe they can amend the application.

the only thing i know was he's divorced already. and he entered the US in a single status also.

i thought so too.. i think its kinda Unfair.. and i think whatever reason he is going to make right now wont make justice if their visa will be denied.. 😕

You don't get to forget the past when it affects your future

all questions to immigration must be answered truthfully

any lie for whatever reason will be reason for denying a visa

getting divorced is no big deal but honesty is

 

the question clearly states you need to disclose all previous marriages and divorces (or deaths of spouses)

you will be surprised at what immigraiton wants to know about your past 

they find out and all must be disclosed

immigration can assume reason the person does not disclose marriage is there never was a divorce

What do you mean Justice if denied? Someone lied on the application. You lie their are consequences, especially with something as important as immigration.

this is under instructions for K1 the 129 form 

 

Penalties If you knowingly and willfully falsify or conceal a material fact or submit a false document with your Form I-129F, we will deny your Form I-129F and may deny any other immigration benefit. In addition, you will face severe penalties provided by law and may be subject to criminal prosecution.

they take this quite seriously

thats what i am saying.. whatever reason he made dont do justification in not being Honest in filing up the form.

i understand the sentiments of her. i think it wont be easy for her to know the consequences . and i not to be judged i guess.. But ThankYou

This is the second time I have read on VJ where someone didn't want to mention a previous marriage because it was bad memories.

 

I'm not buying it. They know what they are doing.

 

i agree that there are many who have selective memory on things that could impact their case.

By basis they mean how did he get the visa to come over in the first place - because if the petitioner originally entered on a visa where you had to be single (unmarried son of a citizen comes to mind as an example) then yes there could be repercussions. 

 

The recent case was for white lies as it were things that happened but if you had been honest it wouldn't have prevented you getting that visa or being allowed in or getting citizenship.

 

This is different, pretending you are single when you are not for an immigration benefit where the immigration benefit would have been denied had it been known will most likely be seen as material misrepresentation. You can get your citizenship revoked if it was granted based on a lie that would have meant that you would not have been given your original visa.
