  1. I won the lottery and submit ds260 for me, my wife and my daughter, now my wife refuse to go with me and want divorce . Do I have to send Kcc email to remove her or to re open my application while I am divorcing and it will take about one week to be officially divorced Is this will affect my application?   2. My mother was petitioned for F4 by her brother in USA. We have received Welcome letter from NVC in 2020. I am the only one child(Son - 32 years old) of my parents. My name was not appeared as accompany. My CSPA age is = ( (my current age 32) - waiting time(13 years, as applied in 2007)) = 19 years I was get divorced in 2016. will i be considered as unmarried. should i request to NVC to add me ACCOMPANY or it can effect/delay this case? Your best opinion required.

It was not registered in the Philippines thats why my CENOMAR shows no record at all. My divorce was filed by my Norwegian ex. If we are going to report our marriage are there still things we need to do? Even its not recorded in the Philippines.Thank you so much!
  4. I want to know if it is a big red flag not to have a joint bank account when you apply for ROC alone (due to a divorce). I am planning to divorce my husband because of infidelity, but I am still on conditional GC. I want to divorce him, and apply for ROC by myself. We have a very different way of spending money, where I save every penny and have some saving, whereas he overspends to the point that he asks me for money. He spends money on alcohol and legal drugs, which I am not happy about. So we have never commingled our finances, and I spend my own money, and he spends his (also he tries to beg me for money when he is short). We have a joint checking account, but we rarely use it. Mainly I deposit money in it, and he uses it. Is this a big red flag upon ROC? Can I still prove that our marriage is real? I have other evidence such as: 1) Lease with both of our names together (although we separated for half a year when I found out about his cheating on me) 2) My car insurance covering both him and me 3) My health insurance through my employer with him as the beneficiary 4) My dental/vision insurance through my employer with him as the beneficiary 5) My life insurance through my employer with him as the beneficiary 100% 6) Photos of us from multiple occasions (even when we were separated, we met from time to time) 7) Texts every day 8 ) Photos of us and his family together on special occasions 9) Join Tax return for 2017 and 2018. (We are planning to file jointly again for 2019, before the divorce occurs if that helps) 10) I can get a affidavit from my best friend who knows both of us really well, proving that our marriage is real. 11) Bills/Mails sent to our address. Is this enough, to cover the lacking of having a joint bank account? What else can we provide?
  5. Hello Guys! I'm new here. Please help us. We are waiting on our case# and preparing our documents in the meantime. My fiance is currently divorced and have a copy of his divorce decree. Will he still need the Certificate of No impediment for his K-1 visa interview? He went to the Jamaica RGD and they told him the certificate will say marriage is found. Should the Certificate say divorced? Please help
  6. Hello guys! I have been reading here on this site for some time, but I would like to see if there are any others who are/were in the same same situation as mine. I am hoping if anyone is familiar with my situation who can shed some light. So I am a Filipina, formerly married, currently being petitioned for a K1 visa. After a few years in the US, my Filipino husband found someone else and got married for some years but eventually got divorced due to differences. He naturalized years after the divorce. Now it gets complicated since my ex-husband is also my current fiance, that is, he and I are getting back together and we have biological children that are in the US. We have submitted valid divorce decrees both for our divorce and his divorce with his 2nd wife. So the interview, 4 months back, went alright. Only a few questions were asked, but I was surprised that the consular officer asked for "Recognition of foreign divorce" in the form of a 221g document, as what I have read before mentions that my divorce does not need to be recognized in the Philippine courts as we would not be marrying here again. So with the help of an immigration attorney, we were somehow able to address this, and after a week or so, they issued me another 221g, this time without the need for additional documentation, but only mentions that my case is currently in AP. It has been around 4 months since my interview. I know it can take months or even years for AP to be completed, but I would like to know if anyone has been in the same situation. I know AP tends to be a little faster in the Manila embassy but some of the things I'm thinking that are delaying it would be the remarriage. Do I need to be doing anything else now, since the 221g is blank, other than watchful waiting? Thank you in advance for your replies!
  7. Im divorced in Norway, when applying K1 visa, theres a need to get NBI CLearance, what marital status i should declare, is it single or divorced? Thank you. By the way, my marriage in other country was not even registered in the Philippines.
  8. Hi everyone, My husband (citizen) got married with his ex wife back in 2010, and filed 130&485 for her right after, and she's a green card holder since then. They got separated sometime in 2015, didn't live together anymore, but filing tax together to save money (which is legal according to IRS). I met my husband in late 2018, so he filed divorce paperwork right after we got serious, and due to the 2-month wait period, etc. the divorce was finalized in March 2019. And then we got married in June, 2019, and filed 130&485 for me after that. Background: I came to US as a F-1 student in 2013 and got H1b visa in 2016. My H1 extension case is pending and my company also filed an EB3 I-140 for me (approved, waiting for PD to be current). SO, my question is, does this seem like a bid red flag? I knew it's gonna be a red flag for them to question more in the interview, etc. Can anyone share their similar situation please? Thank you.
  9. Hi All, I filed my I 751 jointly last year. After few months after filing I 751 jointly i applied for Divorce since my wife is abusing me and hurting me physically, I got divorce under "Cruel Treatment" category from the court. After the divorce, my wife contacted USCIS to cancel my I751 application. My application is not cancelled and still pending. Question 1 : Do i need to inform USCIS about my divorce now or should i wait for the interview and show my divorce (under cruel treatment) when i goto interview. Question 2 : What are the chances of getting my permanent green card ? The fault for the divorce is on my wife side and in the divorce decree its mentioned cruel treatment. Thanks for the response.
