Yes and no.  While the actual changes might not take place, it is very obvious that the work related visas have taken a huge priority over family based petitions.  The HBs are getting approved at a record rate while K/CR are pushing towards historic highs in process time.  It used to be 3 to 5 months from NOA1 to NOA2 and now it is pushing closer to 6 to 9 months.  If NVC goes the same way a K-1 can end up being a full year process.  

They are talking about this being implemented years down the road.   If it even gets implemented at all. My previous comment was to those who have pending cases RIGHT NOW that are worried about the rug being suddenly pulled out from under them next week (like the poster who has an interview next week) and immediately rejected/denied based on any future policy going into effect.

Very true. The odds of this passing at all is very slim. They can re-prioritize but we will all eventually get through this. The wait is frustrating enough!!!

Once I saw the news I immediately came here. Glad to see the consensus is that this likely won't pass and even if it did it wouldn't effect currently pending cases.

the changes are never retroactive, they can't change a petition in course if ever becoming into law

This news seems overwhelming since I don't understand how legislation is passed in the US (at least not fully anyways). I just filed for AOS in July and this is like a punch to the gut.

But I still don't understand this, how this effect current visas? To get the E2 visa, which doesn't lead to a green card, would you need to hav enough points to get the E2 visa to this point based system not apply to the E2 visa? 

 

Does the points based based system only apply when it comes to applying for an actual green card when you are eligible to apply for a green card, not various visas themselves? 

Yeah, it seems they wrote a bill for those without relying current laws and rule. 

 

And the part about the ineligibility of welfare is absurd since you are ineligible current for 10 years or until you become a citizen. That statement basically makes the ineligibility shorter
