I am not sure about pending petitions. Yesterday's news was talking about it would cut legal immigration by 41% in first year. They must be taking into account it would eliminate all pending petitions. If they just stop taking application but still continue to process the pending ones, some country's sibling petitions take more than 20 years. But then it is again not clear what they would be with the already-paid filing fees if they were to revoke pending applications.

That would be a huge problem, if they would cancel all pending petitions that would cost a lot to refund people because it's not people's fault that a new law was approved. and if they would not cancel the pending petitions so the USCIS still will have to deal with sibling, parent, adult children petitions for more than 20 years from now.

Nothing is clear now, I think they would accept some of the bill which is about the workers, but no one knows. Everyone thought that the Congress last time was about to repeal and replace ACA but it failed.

I could see them getting away with not refunding.  However it isn't going to happen.

Well, basically the whole law is a big mess. It seems written by someone who has no clue about the laws and regulations to show off to their ignorant constituency. It doesn't surprise me.

 

That point system is also absurd. They give 10 points for being young and 25 points for a Nobel Prize? That is not even comparable. Besides, if you get the Nobel Prize you can get a GC through EB1 without having to go through this silly system.

 

The point system is ridiculous, I agree.

The whole thing appeals to Trump's base and that is why he misleads with the "immigrants immediately going on welfare" which is another

one of his lies, however the average person does not know that the 5 year law already exists. Crazy !

Seriously, though.  

 

Does anyone really believe that Trump has suddenly become so well-versed in how the legal immigration process actually works in the first place?  

It sounds like all of his proposed regulations are just off-the-cuff ideas based on wanting to copy how another country does things, without finding out what sort of regulations are actually already in place.

 

It was like when he proposed "stricter vetting of immigrants"...uhm...yeah, because we haven't already been strictly vetted for a year or more already.

 

I honestly think that Trump imagines the immigration process as someone just filling out an application and then USCIS throwing a party for them a week afterwards with cake, balloons and a gift-wrapped Citizenship Certificate...

Immigration benefits being an easy-peasy thing for "just anyone" to get is what he wants people to think.

Immigrants being uneducated, mostly criminals, non-English speaking and never working a day in their lives is what he wants people to think.

 

I think the White House is forgetting that the new regulations not only affect GC and visa applicants...more importantly, the White House is forgetting that the new regulations also greatly affect US CITIZENS who want to apply for immigration benefits on their loved one's behalf...the same Citizens who will be casting their votes during elections.  The same Citizens who will be pressing their congress representatives and senators to not support these new regulations.

 

This legislation as it stands is not going to be passed...if it does?  It will be an extremely watered-down version of what he is initially proposing.

Aside from a moral obligation to take in refugees ( numbers open to discussion ) this country is not based on " the right kind of immigrants equals the rich.

Nobody is saying bring in illegals. 

Every human being has something to offer, I find that people who came over as the poorest work their butts off to become entrepreneurs with varies businesses, creating jobs and working in the blue collar and service industries. Balance is the key not some stupid point system. 

These poor people work harder than many lazy Americans on welfare.

We would be out of luck then if this bill passes anytime soon in it's current form. Our F2B applications have a priority date of 8/13. My wife's brother and sister wouldn't likely enter the USA until 2020.

I agree, illegals should not be in this country.  With this new regulation Trump is choosing to target the people who want to do it legally, instead of illegals.

 

Seems counterproductive to me; making it completely impossible for some groups of people to legally immigrate will only amount in more people searching for illegal ways to come across.
