Travelling during AOS

Hi guys. I hope everyone is doing well. We are about to start our AOS. Yay!!!We were planning to visit my family the first week of April ( we are flying. cant drive because it is too far). But my husband K1 visa expires in March ( his passport is still valid) and the state wont issue a government ID without an EAD from immigration. Any ideas about what we can do?

there is nothing you can do, when you send the AOS, you will be sending the i131 travel permit, it can take 90 days to be received

 

so he will most likely not be able to receive it by April. If he leaves without the travel permit, he won't be able to enter. once you send the packet you can try to expedite the travel permit, but you have to justify why do you need it urgently

 

if not, plan to visit family in July just in case it takes more time

Are you traveling within the US? If so, he can travel with just his passport (and bring his NOA-1 for the I-485). 

 

Traveling abroad is of course not going to be possible.

If you don't have an approved AP, then you cannot exit the country. The K-1 visa expiration point is irrelevant at this point...it's a one-use visa and has already been used. You can request an expedite for AP, but a voluntary choice to do a vacation is very unlikely to get it. It's normally used for things like medical emergencies, funerals, etc.

Then his passport and a copy of the NOA for the I-485 will do just fine (just in case someone asks to see proof of legal status).

thank you everyone. also, I know this i not the panel but I am filing I 864 and  I am confused about part 5 -2 ( asking about the people not sponsored in this form). it says to add 1 if you are married but I am sponsoring my husband.

If you are married, you can apply for a SS card and use it to get a drivers license

At the DMV they also want to see a EAD/GC in combination with a SSN 99% of the time.

That varies heavily from state to state. In TX, all you need is an ID, SSN, the NOA1 (proof of legal status), and proof of TX residency (usually a utility bill or similar is sufficient).

That's why I said 99%, 1% is for those knowing NOA1 suffice but mostly it's a hassle. Like Tennessee.

You only add 1 on the married part if you are married to someone else - like if you had a joint sponsor that was married to someone, then the joint sponsor would add 1 for his/her spouse.

While traveling in and near El Paso, make sure you have all necessary documents showing your legal status in USA. There has been a lot of activity in this region by border police over the last couple of weeks.
