Section 221(g) of the Immigration and Nationality Act

It is often the case when an applicant for a visa is told that a final decision cannot be made on his visa application immediately. In doing so, the consular officer invokes Section 221(g) of the Immigration and Nationality Act and informs the applicant that the case will be put on hold until the applicant’s eligibility for the visa can be determined. This processing “time-out” is taken frequently: more than 900,000 visa applications were subjected to 221(g) during 2014. Technically, 221(g) is considered a denial; in subsequent visa applications and registration in the Electronic System for Travel Authorization, this must be disclosed. Nevertheless, the overwhelming majority of 221(g) denials are overcome and visas issued.

There are, in essence, two types of 221(g) cases:

  1. Washington-related “administrative processing”, in which a clearance or approval is required from an interested agency or agencies in Washington, D.C.
  2. Post-related, in which the consular officer requires additional time, information, or documentation before making a final visa decision.

They ask me how long have I been in relationship with my ex girl friend. I mean my children mother, and I told them 10 years and she say while am with her for ten years, she think am still with her due to what I said and I told her am no more with her for the past 3 to 4 years . And she said no so don't believe so my case is sending back to uscis.

Bro to be frank am no more with her my friends know, my neibours,my family, her family they all know I have breakup, with her and am now married to usc. The point is since I told her I have been with her for 10 years, she think am still with my ex girlfriend I mean my children mother. I have no Marriage record even if they cross check.

The above is not helpful. It is a poor summary. What you need is a detailed report including each and every question asked, in the order asked, and each and every answer given. The devil is in the details and you haven't provided any. I'm not who you need to convince. Your wife needs the information so she can convince USCIS to reaffirm their approval of the petition. If you are serious about being together with your wife in the USA, you'll have to put 100 times the effort into the report you provide for her, than you did for what you wrote above. Otherwise, you can kiss this marriage goodbye.

The recommendation from the CO is that the approval of the petition be revoked. A NOID comes only from USCIS, months after the petition is sent back. The visa has already been denied. Only a reaffirmation of the petition approval can provide a chance for the visa to be reconsidered.

One of the posters stated 'in a few months, you will get a NOID / NOIR'. Believe me, it will be more than a few months. It will be at least one year to get the NOID / NOIR. It takes 6 months alone for the file to get from Ghana back to USCIS, then it takes at least another 6 months for USCIS to let you know the reason for denial.

I know because my husband was denied in September 2015. His case reached back to USCIS on March 4, 2016, and we're still waiting for the reason and it's almost October 2016.

It's also possible for USCIS to re-affirm the petition without any further involvement, and for them to send the petition back to the NVC on their own.

A NOIR isn't guaranteed.

they may have spoken to your neighbors even receive a letter or other communication with the mother, prior to the interview.

Do they really do this? If this were my case we would totally be in trouble if they spoke with the mother of his kid! She's so envious and crazy she'd lie and say that yes they are still together.

The visits are good to prove your ongoing relationship when you have your 2. interview if USCIS reaffirms your case.
It will take 12-18 months + for the process from return to 2. interview for Ghana. Keep having her visit and collect all relevant evidence

of your relationship.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
