Hello,

I'm a US citizen and I've filled I-130 and I-129f for my wife. We though filling I-129f for K3 visa would be the quickest way for my spouse to come here to US but we've later read that it rarely gets processed before I-130 and timeline is the same as I-130 (about 5 months).

Now we're just thinking that maybe we should cancel our petition and just wait for I-130 to be processed (we got NOA at the end of June '16 so few months to go) and then go for IR-1 Visa (we've been married less than 2 years).

I'm looking for advice, should we withdraw I-129f or just wait? What if it gets approved before I-130? Does it complicate things if we want to wait for IR-1?

From what I understood about the k3(was planning on doing it until I found out it takes longer and it's not really used anymore) once you receive the noa2 that's when you send the I-129 along with a copy on the I-130 you do not send them together until you receive the noa2

I thinking calling and letting uscis know that you made a mistake with sending the I-129 would be you best option that you were misinformed

The I-129 will be administratively closed at the NVC phase where you will follow the CR/IR path.

You don't withdraw it.

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Renewal application send for EAD/AP : May 31,2016 (AOS pending over 1 year). Received June 2, 2016,Notice date June7, 2016, emails,texts, NOA1 hard copy

Service request for pending AOS June 14, 2016, tier 2 said performing background checks.
Expedite request for EAD/AP Aug 3, 2016, Aug10 notification >request was received, assigned, completed. RFE letter requesting evidence for expedite, docs faxed Aug18

AOS Interview letter received Aug 12, 2016

AOS Interview September 21, 2016.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

No need to do anything. The I-129F will automatically expire when your I-130 is approved. No need to call them or anything. Just let it run its course.

Incidentally, it will be CR-1 that you receive if you have still been married less than 2 years when your spouse arrives at the POE. IR-1 for those married 2 years or more.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

Thanks all. I think we will just wait for I-130 to run its course. So even if I-129f gets somehow processed before I-130 and K3 becomes available it would still be OK to wait for I-130 to be processed and go for CR1, right? I don't want to mess everything up :)

This is wrong. Once the NOA2 comes, the I-130 is approved, so it's too late the file the I-129F for spouse.

The OP should do nothing. The I-129F will be administratively closed by NVC when they both get there at the same time. USCIS has been joining the two files and approving them together, since late 2006.

Facts are cheap...knowing how to use them is precious...

You are correct about the noa1 I considered doing it a while back but decided to dcf since it was the fast route for us

We withdrew our 129 when we married

as you are married filing 129 was in error

in the chance it gets all the way to an interview, and is discovered you are married and followed thru with all the supporting documetns NVC and interview stage, the 129 will be denied

do no assume they will catch the problem before getting to interview stage

with a denial for misreprentation on all this as you are married, a denial will affect the 130

it will look like you did both to accept the one that happens faster

not good

This is a spouse case. Filing the I-129F was not an error, just a waste of time. They were trying for the long unavailable K3 spouse visa, which does require filing the I-129F in addition to the I-130.

The I-129F I filed for my wife in 2005, resulted in a K3 visa for her and a K4 visa for her daughter. These visas have been virtually unavailable since 2/1/2010.
