Denied cruise boarding by Carnival citing improper docs , have valid EAD/AP combo card

The third party site actually said if he was "living" in the US he didn't need a visa. I think he assumed living meant staying . Until you are authoried by the correct document such as a green card you are not "living" in the US AP/EAD is not final authorization to live here.

This will not be over quickly. You will not enjoy this.

I tried convincing them , the reason they gave me was the documentTion was not good enough to reenter US. The stay in Cozumel was for 8 - 9 hrs

What visa did you use to enter the US?

On what basis were you using to enter Mexico?

I don't agree. All the companies need to deal with so many people and so many nationalities that it would be unrealistic to think they are going to have time to help people with visa issues.

Completely agree with you.

Travel agents help with documents. People pay for their assistance.

Cruise lines, airlines, and others are not paid to help with documents. That's on the traveler.

hmm gotta do your research before any type of traveling esp when your using that ap combo card , just a lesson learned next time confirm you can travel without risk of wasting money , simple as that

I checked the Mexican embassy site before booking the cruise. Yes Visa is required for Business / tourist , but is not required for cruise visa if you hold indian passport

I have chosen the status as non-immigrant to us here.

I think OP is AOSing from tourist visa.

I am quite sure it was nothing to do with his documentation to re-enter the USA. Carnival cruise line, as big as they are, will definitely have seen an EAD/AP card before.

My guess is it's the visa for Mexico issue. It would be nice if it was realistically possible for people employed in the travel industry to know all the rules and regs for all countries for all passport holders. Since governments are at liberty to change entry requirements whenever they want, it would be impossible to keep up with everything. That's why the onus is in the passenger to check his own requirements for his own situation. It seems that the OP relied on unofficial third-party information.

I work in air travel and it's a headache to know which passengers need visas for which destinations for which purposes or durations.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

Exactly what I've been trying to point out to OP who now seems to be purposefully avoiding answering the question.

OP, wgcsince2009, it is almost certainly a matter of whether you were allowed into Mexico or not which makes it a Mexican immigration issue, not a US immigration issue.

So, the first question is, is this 3rd party site about "closed loop" cruises correct or not? If yes, then it's possible that Carnival was in the wrong.

The second question is if the 3rd party site was wrong, did you need a Mexican visa or not? That will entirely depend on what type of visa you have/had with the US, and the status of that visa. It is clear that EAD/AP is not enough to "count" toward the exception quoted above. It seems that someone at some point talked to the actual Mexican consulate about their K1 visa and EAD/AP and were told it was fine. If you had a K1, then perhaps you were wrongly denied (or: that person was wrongly admitted). If it's anything else, and it's expired, I'd assume you're out of luck. If it is a K1, I think this highlights a serious downside to that visa-- it's so unique and works unlike any other process that barely any US officials know how to handle the process. I don't expect a foreign country's officials, or a cruise line's employee to get it either.

No one can help you any further until you say what visa you're here on and if it is expired or not. Just saying "non immigrant" doesn't help in the slightest. If you don't want to, then you need to continue this conversation with the Mexican consulate which is what you should have done in the very first place and which is where these questions actually belong. If they tell you that you can/could have entered Mexico, ask for them to put that in writing and deal with Carnival from there.

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

29 Jul 2016: Online service request for late EAD (Day 104)

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:
