Denied cruise boarding by Carnival citing improper docs , have valid EAD/AP combo card

Hi I was denied boarding a cruise ship from Galveston to Cozumel, Mexico and back. The documents I have provided was valid Indian passport and also valid EAD combo cards which also serves as i-512 advance parole. Both these documents are valid till 2017 november. The cruise agents denied boarding and I lost all the money I had paid them . As producing insufficient documentation is the mistake of passenger. I had my family with me and they also had valid EAD combo cards. I did travel on the same card to India in Feb 2016 and came back . Not sure what course of action to take.

What's your US visa and when does it expire.

The two things I can think of is first-- they made a mistake in which case you'd have to fight them for your money back (I checked their site and it says if yo do not have proper documentation, then you don't get a refund). If you can prove to someone in management that you DID have the proper documentation then you can probably fight for a refund. Second, though, I checked the Mexican Embassy in India's site and it seems like Indians need a visa to visit Mexico *unless they have a valid US visa*. However, if you're in AOS, I'm wondering if your US visa is expired (even though your stay in the US is legal, and your US re-entry would be legal, if the visa is expired and Mexico needs a valid visa for you to enter......there's your problem. They said valid visa not valid EAD/AP). Basically, it could have nothing to do with your immigration status in the US, and everything to do with Mexico's visa guidelines.

Did you have a visa for Mexico? If not, perhaps that's why you were denied boarding. Only green card holders, U.S. Citizens and other visa-free nationals are allowed to enter Mexico without a visa. As a citizen of India, you must have a visa for Mexico.

Now the question is does OP have a valid, unexpired US visa? And does EAD/AP "count" (I'd guess not because that is really really in the weeds, they're lucky that Mexico is treating a US visa as "good enough" to not need a tourist visa, I wouldn't expect them to extend and flexibility of our AOS process, or even possess the knowledge of the ins and outs of it). My strong suspicion is that OP should have gotten a Mexican visa.

I checked the Mexican embassy site before booking the cruise. Yes Visa is required for Business / tourist , but is not required for cruise visa if you hold indian passport

Do you have the link from the Mexican embassy site? That's a third party site. Not that they're wrong (necessarily) but they could have incorrect or outdated information. The Embassy of Mexico in India site says nothing about the cruise exception (that I can see).

The issue may be that you are not a "resident" yet. Until your greencard is approved you are not a resident. You are an applicant for reseidency.

This will not be over quickly. You will not enjoy this.

If the OP came on a K1 visa then that visa is no longer valid as it is one time use. The AP/EAD is not a visa but rather legal permission to work and enter the US. I wonder if this is the problem.

The issue may be that you are not a "resident" yet. Until your greencard is approved you are not a resident. You are an applicant for reseidency.

The issue isn't him being allowed back into the US. The issue is him being allowed into Mexico. People travel on AP all the time. Where he may have gotten tripped up is that people with valid multi-entry visas to the US are allowed into Mexico visa-free. OP hasn't confirmed but it's sounding like his US visa is expired (with AOS in process, AP would let him back in the US but NOT into Mexico), which means he should have applied for a tourist visa to Mexico. Maybe. OP points to a visa website that seems to show that cruises are the exception to this, but that website might be wrong.

Either way, I'm really sorry this is happening. I think that if you reach out to the cruise line and explain this, they may do something for you. It's not like you didn't even think about this stuff at all, and this is a very specific thing that maybe *maybe* they'll give you a credit or something.

It is the sole responsibility of the guest to identify and obtain all required travel documents for the entire cruise vacation and have them available when necessary.

The cruise line isn't going to refund you anything.

Yes, but sometimes customer service people are flexible (and I'm speaking as someone who has worked in customer service for a large company before). OP has a website that shows an exception for cruises. It does seem like this would have been the issue at embarkation, and this is at least worth a (calm) call to explain. Worst they can say is no, and it's an expensive lesson learned.

Carnival, per OP's title. Their website says much the same (does not give a visa website, and suggests contacting the consulate directly). The issue here is that *MAYBE* because OP's has a US visa (and that complicates things because people with US visas don't need Mexican visas) and the fact that he did do some due diligence with that third party site (which it sounds like he thought was the real consulate?), which may have given old/outdated information that they could do something to help him. Not likely at all. But worth a phone call at the very least. There's policies in place for a reason but sometimes policies are flexible, depending.

My sister has a tourist visa multiple entry here at the US and she is going to mexico. I printed this below just to make sure that she will have no issues going there this coming October.

In accordance to National Institute of Migration of Mexico regulation, effective May 1st, 2010, all foreigners regardless their nationality traveling to Mexico, with a valid USA visa, will be allowed to visit Mexico through any port of entry – air, land, sea- without a Mexican Visa; this includes tourist, transit and business trips.

· Holders of a valid United States multiple-entry visa do not require a Mexican visa to travel to Mexico for a period of entry not exceeding 180 days and for non-gainful activities. The Electronic System for Travel Authorization (ESTA) is NOT considered a valid U.S. visa for the purpose of travelling to Mexico under the exemption of the Mexican visa. The U.S. visa must be stamped on the current passport.

07/24/2019 - Case Approved online status.

07/31/2019 - Received Green Card!
