3rd DWI during process. Will affect us?

3rd DWI in a short time frame should be a HUGE RED FLAG! This persons legal problems will be your legal problems once you marry them. The legal obligations, jail time, financial drain, probation, loss of driving privileges, ignition interlock...not to mention the impact emotionally of spending your life with someone who whether they realize it or not has an addiction. I am not judging anyone...only sending out a warning from someone who see's how much of an impact DWI convictions have on families on a daily basis. I am a probation officer who supervises repeat DWI offenders. It does not get easier...

Forgot about ignition interlock. Basically permanently negatively altering the car. I've heard stories about problems with these devices whereby even under ideal scenarios, the car won't start. That device is a pain and the OP's Fiance will no doubt need one. Sometimes the Judge will order one on 1st offense but 2nd at the latest. He is on #3.

In NY ignition interlock is mandatory for 1 year on all DWI. Even first time offenders.

I sincerely hope a background check at USCIS stage opens up the arrest records and stops the petition

so, you don't put more into this relationship

i know immigration mostly is trying to protect the rights of the US citizen but i don't want to see either party go thru with what appears to be a bad plan for a future

i lost a 17 year old daughter when a drunk driver ran over a group of kids crossing the streets coming out of a restuarant at 6:30 PM (not even dark out)

i have zero sympathy for anyone driving under the influence of alcohol or drugs

forget this man as there are decent ones out there and the best to you gf

we all want a better life / don't settle for anything less

:cry: I am so sorry for your loss, no parent should have to go through losing a child because an adult can't call a taxi to take them home when they've been drinking. It is just so senseless and horrible.

Very possible if they find out about this, the case will be HELD , and have to go under treatment for alcohol and submit to random alcohol test for a year as they do the drug tests.

It can delay her visa for a year IF they are willing to do alcohol testing on her at all. Other wise, it can flat out be denied.

Texas is truly cracking down on DWI drivers. I live in Texas, and I would not risk taking even one drink if I was going to drive.

Also when the beneficiary goes to get the police cert clearance as needed for USCIS, wouldn't the arrests for DWI show on there? That right there can end the visa process I believe.

You filed June 20th 2016? As in a month ago?

So your saying your fiance received 3 DUI's in the span of one month?

The fact that you are discussing this so non-nonchalantly is extremely disturbing.

I sincerely hope you consider carefully getting into a vehicle with this person, let alone a marriage.

Coming from someone who has lost a friend and family member to drunk driving in a state with notoriously lax drinking and driving laws.. get your fiance help or get out.

I read it as if the USC had two DUIs before they filed (which you don't have to mention on the i-129f because it only asks for "three or more"), but that the third DUI happened after the petition was already filed. We don't really know when the first two happened.

Not that the difference matters, it's still very, very bad.

OP, you should probably call USCIS about this and ask how to handle it, obviously it needs to be mentioned somehow as the i-129f specifically asks for it when it's three or more.

Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
