Hello my name is santosh Iam from india (Hyderabad ) was rejected in 2008 for F1 visa 212(b).

I have Applied for waiver in December 2015(B1-B2)

Waiting since than couldU plz tell me how much time does it take to get response,

Visa officer accepted my waiver and said it might take 6months to 2years.

Thank you for the response .. But is there anyway I can call somebody to know about what exactly happening on my case. It's a whole big story I had to deal with since 2008 ?, finally when I was said my waver was accepted and will let know in and about 6 months -2 years, again i don't see any kind of response and I don't know whom to contact ?? Please help

Correction : I had applied for waver in 2014 ( it's almost 1 year 7 months plus since I have been said my waver is accepted)

No clue where to and how to find out.

My company in INDIA has offered me to visit onsite client location .. And I don't wanna miss it second time.

Please do me the needful..

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

What's 212b ?

212(b) is just a general rule about visa denials. We don't know the reason for denial.

"

(b) Notices of Denials.- (1) Subject to paragraphs (2) and (3) if an alien's application for a visa, for admission to the United States, or for adjustment of status is denied by an immigration or consular officer because the officer determines the alien to be inadmissible under subsection (a), the officer shall provide the alien with a timely written notice that-

(A) states the determination, and

(B) lists the specific provision or provisions of law under which the alien is inadmissible 19/ or adjustment of status.

(2) The Secretary of State may waive the requirements of paragraph (1) with respect to a particular alien or any class or classes of inadmissible aliens.

(3) Paragraph (1) does not apply to any alien inadmissible under paragraph (2) or (3) of subsection (a)."

hello Iam santosh from india (Hyderabad),

Applied for student visa in 2008 got refused under 212(a).again I have applied for waiver in December 2014 (b1-b2).

Visa officer accepted my waiver on positive note and asked me to wait for 6-12 months for the response .

It's been almost 18months I haven't received any mail regarding my case.

is there anyway I can call somebody to know about what exactly happening on my case. Maybe you have a better chance having your company apply for a work visa because 212 is for misrep dought youll get back from that if they need to trust you arent lying when you say youll go home.

Can your job apply for you?

he has a ban for misrepresentation(lying), a work visa cannot help bypass a ban. and getting a work visa isn't easy to obtain in the first place. Unless he were to have a highly specialized degree where an American cannot fill said position it is not an option in the first place. by law US companies cannot hire foreign workers to fill US jobs unless they cannot find a qualified US citizen/resident. Not to mention it is a STUDENT visa he was denied for. Lying to US immigration has dire consequences.

I have seen you in several threads over the last few days giving out and suggesting wrong information. If you do not know the answer to a question/and or have no clue what you're talking about, don't answer and don't guess
