Separation might happen! what is my status afterwards..

Hi all,

I was wondering if my marriage with my US citizen spouse has ended -God forbid- Just few events happened made me insecure in our relationship and she started to bring the idea of separation if things won't be okay when days progress. I know such trivial things happen in any marriage. Just in case if divorce happened, what will be my status in the GC process ? FYI- I have had conditional GC since Feb 2016

1- Will I be able to renew it to 10 years on my own without being married to my spouse ?

2- If the answer is no, and I have decided to marry someone else, will I have to start the whole process again from the beginning if I married someone else ? And the GC will be given to me conditional for only 2 years as now ? OR The time elapsed in the previous marriage will be counted and start resuming the rest of the 2 years with the new spouse ?

Please tell me your thoughts about it since I feel insecure and separation could happen anytime. I have no control over it. Thanks

From all the posts that I have been reading lately similar to this situation, it seems you don't need to worry about ROC if you have enough evidence of a real marriage. Just follow the advice and guidelines. You have been a member on here since 2014 so I would be surprised if you don't already know the answers. I will give you a personal observation however. My observation concerns what you are saying in your post and I apologize if I am misinterpreting the situation. However, your words are far more concerned with your ROC chances than your marriage. I'm not going to judge but don't be surprised when the responses you get to your posting are a little harsh. You say there are events and you say they are not in your control. I would suggest time spent fixing what is wrong with your marriage first is your priority. If you stay married your worries are over right? If all you are only concerned about your ROC and GC and not your marriage then you're wasting emotional energy that might be used in fixing the marriage problems you are experiencing.

you are gonna get yourself arrested if you tell them you are going to get married again even though you are not divorced. it would raise big red flags on your status and him too.

Saying you want to be married to more than one woman is not a crime and he won't be arrested. If he were to get married to both however... but that's not what this is about.

It never fails to shock me when someone brings up marrying another USC at the first sign of difficulties in the marriage they're in, what happened to the love you both claimed through the immigration process? does it disappear with the arrival of a green card?

Asking the question makes it appear that the green card is more important than the marriage which is sad :(

That's because, unfortunately, much of the time it is.

1. You may with a divorce waiver and evidence of a bonifide marriage in good faith

2. A quick turnaround marriage is going to raise huge red flags. I'd concentrate on ROCing ok your own

1- Yes our marriage entered in a good faith and we have our names on mutual stuff like insurance, bank account.

2- I hate to live a lone, that's why thinking about 2nd marriage if separation happens. I can hold on it till remove conditions as you recommended.
