Hi Everyone,

I have a question about getting a K or other visa for my sister.

My sister in the Philippines has been conversing with her boyfriend from the USA online for over 6 months. Just recently her boyfriend (an older gentleman) attempted to fly from the USA to the Philippines. However, he has a big fear of flying and while he made the first leg of the flight, when he boarded the second leg (LA to Japan) he had a panic attack and almost heart attack and had to get off the plain on the tarmac and was rushed to the emergency room. Now he is afraid to try and board a plane again and wants to know if there is any way my sister can visit him for their first one on one meeting.

Is there any provision in K or other visa that would allow my sister to come to the USA under conditions etc...

They do want to get married, but the fear of flying/health issue with the boyfriend is preventing the first meeting.

Any thoughts or ideas on how to overcome this issue??

Maybe they can go the K-1 route. From the USCIS website, the K-1 the requirements are:

You met each other, in person, at least once within 2 years of filing your petition. There are two exceptions that require a waiver:
1. If the requirement to meet would violate strict and long-established customs of your or your fiancé(e)’s foreign culture or social practice.
2. If you prove that the requirement to meet would result in extreme hardship to you.

Maybe with the help of a doctor's note documenting the fear of flying they could go with option 2

2. If you prove that the requirement to meet would result in extreme hardship to you.

Maybe with the help of a doctor's note documenting the fear of flying they could go with option 2

Won't happen.

He could drive to Mexico or Canada .... She will have to try and get a visa to all those countries incl. USA to prove they have tried everything.

Why? There are alternatives to flying or third countries that would not require the USC to fly.

Also, there's no chance of the meeting requirement being waived without the foreign half of the couple at least attempting to get a tourist visa.

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

I agree, meeting in a 3rd country is the best option. She'll probably have an easier time getting a visa to Mexico and he would be able to commute down via train, bus, car etc.

As long as they document their face to face meeting, doesn't matter where, they'll satisfy the requirement.

I have no idea of any category except visitors visa. However, there's a huge cases of visa/ marriage fraud high in Philippines. Especially with older man involved, I can't tell.

I would suggest they meet in a 3rd county.

I would suggest Costa Rica.

For him, it is accessible by land.

For her, because that country does not require a visa for Filipinos.

Yes if she can obtain a visa to visit somewhere, they can meet there.

They do want to get married, but the fear of flying/health issue with the boyfriend is preventing the first meeting.

Take a boat.

This is a good point to consider, have the fiance go speak to a doctor about the extreme anxiety and the doctor will provide something to help.

  • A single Filipina visiting the U.S on a visitor's visa will never happen. Plain and simple. Nearly a 100% denial rate.
  • She will also likely be denied a visitor's visa to Mexico or Canada because of their proximity to the U.S.
  • A waiver (K1 meeting within 2 years) is about as likely as the Cubs winning a World Series Pennant

I'm not discounting his fear of flying, but he is going to have to man-up and make this happen if he really loves her. If this guy can't even fly to LA, he is most certainly not going to make it to another a neutral country. He may consider Anti-anxiety medicine, or something to help him sleep while flying. If he can afford it, a First Class seat would certainly alleviate some of the anxieties associated with flying (tight spaces, small seats, sitting, crowds).

Bottom line - he absolutely, positively, with no exceptions must visit her at least one time before filing an I-129F and pursuing a K1 Visa. There is no doctor's excuse, or rationally justifiable exception to qualify for a waiver (in their situation). Even in the most extreme and severe situations, obtaining a waiver is rare. Waivers have been denied for severe medical reasons, military deployments, religious reasons, financial reasons and even in judicial / legal situations.

Highly misleading about Mexico. Mexican visa is very easy to get. I would get visa to Mexico and let them meet their.

No such thing as a girlfriend or get to know each other visa. Will have to physically meet somewhere before the boyfriend can file the K1 petition, and be sure to keep back up proof.

Have you met your sister's boyfriend in the US? I'm a bit cynical when people say are ready to marry even before meeting.
