Visa denied for petitioner original divorce papers

Our interview was today at the Paris embassy and my fiancé received a 221(g) denial until they receive my (USC petitioner) original divorce papers. I'm trying to not get upset, but I checked everything at least 50 times and nowhere does it say an original document from the petitioner is required at the interview. In the Packet 4 it only says to bring the original of the Applicants which he did and nothing was mentioned about the petitioners. They had copies of mine which they acknowledged but refused to accept it saying the original was required. Okay, so off to DHL I went and the papers will be there Monday morning. They kept his passport and said everything was okay and the visa would be issued after they received the "missing" document.

This is so frustrating and I know I'm not the only one to feel this just needed to vent a little. It is beyond me to understand why they would accept photocopies of my birth certificate and passport but not divorce papers. Now I'm worried we will go into Admin. Processing and further delayed.

At our AOS interview, the IO asked to see the original of my (petitioner) divorce decree. Thankfully, I had brought every piece of paper associated with our immigration journey until that time, and could comply. It likely saved us from getting a RFE, and instead my family got their 2-year GCs.

Hopefully something that you can take care of promptly.

Yes I have already sent the original document via DHL should be delivered Monday morning.

I understand how you feel. I sent an original divorce decree with my I-129f petition. One would think if it was an issue you would've got an RFE before NOA2.

Oh well don't stress now. You'll be with your fiance soon!

No, that is not a denial, it is a request for more information.

It's not. That should have been sent with the 129f filing, but sometimes things get lost.

In the Packet 4 it only says to bring the original of the Applicants which he did and nothing was mentioned about the petitioners. There you go. Not a denial but a conditional approval.

all our documents had to be originals and at the NVC stage included death certificates of my late hussband, his dad, my dad, birth certicicates of grown children

It clearly differs from embassy to embassy. In the checklist we get from the embassy in Sweden it says to bring:

"MARRIAGE TERMINATION/DIVORCE DECREE(S): If you or your fiancé(e) were married previously, obtain one certified copy of the divorce decree(s) or death certificate(s) to prove the dissolution of each of such prior marriage. If applicable, please note that most petitions only include a regular copy of the divorce decree(s) so please make sure to bring the certified copy at the time of interview."

Luckly we checked these things early on so I could get it with me home after visiting my fiancé in the US, one less thing that needs to be shipped to me.

It was always my understanding that the expectation was that originals would be available at the interview. I know folks used to have to send the actual originals to NVC and then have them returned at the interview but at some point it was changed that a copy would go to NVC and originals available at interview. Similar to how our Canadian applications were done electronically so essentially copies of everything but originals would be made available if asked for at the interview.

Don't fret about it now. Just know going forward for all of your steps in the future to drag your originals with you just in case.

I went to my husband's interview and CO did ask me to give him original of my divorce certificate. I never received it back.

I'm not sure how you do it but you need to request that document back. You will need it in the future.

there is a form to fill out in send in to get originals back, google it you will find it.
