MY Husband is dead

Hello folks

Greetings to you all i married my US citizen husband in my country couple of years back in 2001 he fail sick and died,in my country (Malta) and was brought and buried here in the US.I came for the burial and want back after it.

Now when things moved a bit hard for me i had to relocate my self over here to this place though as i still came in here as a visitor then.Like 3 yrs now, i have been in this country,Just recently i decided to know if i can adjust status with my dead husbands marriage to me .

Please folks i need your advice as to what to do if this is possible to file for adjustment of statues with all my documents i have with him even the death certificate.

because of the love i have for him i have remained single till this date.

Folks your help is highly appreciated,and thanks to you all that will take your time to read this and advice me what to do .

This fact sheet maybe of use. However if I'm not mistaken, it seems that you should have filed within 2 years of the death to qualify.

You said you are trying to adjust your status based on your marriage which preceded your husband's death. Is this correct?

Could you clarify a few things?

You say he died in 2001. That would make it 14 years since his death. Did you mistype the year?

You say your country is Malta but your profile has you as being from American Samoa. Is it in fact Malta?

Unfortunately you have to file within two years of your US citizen spouse's death, so you are now no longer eligible to immigrate through them.

The immigration benefit you are asking for is through the husband who is unfortunately no more and no documentation was filed to adjust status and you never established yourself here in the states.

Those are difficult flags to get by.

I doubt there's a way.

But i would suggest seeking the counsel of an immigration lawyer.
