Hi all

This is my first VJ post, and first I want to take the time to thank the community for all of their help so far. We managed to build our case based on what we found on this website. Huge THANK YOU to all!

Now, here's where it gets darker - we got NOA1 at the end of December 2014 and that our case was assigned to the TSC. And this is when my anxiety started kicking in because we have a wedding set for August. I doubt we'll make it if TSC takes until July to get to our case. Now, to ease my anxiety, can someone please tell me everything's going to be OK and that we will make it in time?

Thanks!

no. you will not. August wedding??

you'd be lucky to be approved by the TSC by then. Sorry but I want you to brace yourself for the reality of what's going on at TSC right now

so let's say by some miracle, you get approved and out of TSC.. that's just 1 step of this process! you have to go to the next steps not to mention the entire interview process, etc..

August is wishful thinking..

I'm sorry to be so blunt, but I honestly see no way for this entire process to be completed for an August wedding.. :(

Boy. That's a tough one. As much as we'd like to reassure you of your hope, I think we'd be doing you a disservice. As things stand now and as they're predicted toin develop in the coming months, July would be an excellent result for you, being a non-filipino, late December filer in the TSC. But ya never know what can happen.

Finally, don't forget to include the following time factors when making your plans:

1) time for your petition to travel from the TSC to the NVC

2) your wait time while your petition is in the NVC

3) travel time from the NVC to the embassy in your beneficiary's country (Netherlands)

4) time that you'll have to wait until your interview date at the embassy

5) wait time after the interview for the actual visa to be placed into your beneficiary's passport, if any. That depends on a few things.

And that doesn't include other complications like RFEs, etc. The above assumes that your petition makes it through the process uneventfully.

But it sounds like you did your homework, so you're probably aware of that. Just sayin'...

Good luck with your journey! We're here to help.

August wedding sounds almost impossible, unfortunately. :( And we can relate to you because we also had everything planned and had to make adjustments recently.

We submitted our petition/got NOA1 in late August 2014, and set a wedding date for mid-April 2015 considering the processing time wasn't supposed to be longer than 5/6 months. Unfortunately, TSC is very slow and they're still processing June/July cases. IF we're lucky, we may get a NOA2 in late February/March, so a few weeks ago we decided to move the wedding to July.

I know they tell you not to plan anything before getting a visa but honestly 90 days to book everything is a little too crazy, so if you want to just go ahead, be prepared for at least an 8 month process and plan around that.

You should probably reschedule your wedding. October/November is more realistic, but I would wait for this part of the process to be over before planning a wedding. That way you can enjoy doing so, rather than worry endlessly over variables you cannot control. I'd hate for stress to override what should be a joyous occasion!

this ^

honestly.. pour your energy on this process until it's approved and you have your baby with you

don't even waste time right now planning a wedding/etc

your energy should go to what matters.. getting her the visa so you two can be together

Also keep in mind.. all that's needed is for you two to be married within 90 days of her entering the usa.. I myself am going for a civil wedding god willing my fiancee's visa is approved/etc first rather than a full-out church wedding

Sorry...

Everyone here (at least sensible people) are going to tell you to

NOT hard book your wedding plans until your fiance(e) has passport and visa on their hands.

I filed I-129F in Dec/2013, and my fiancee arrived in US in Sep/2014.

Yes, she could have been here as early as July perhaps,

but we had to get extra documents (police certificate from a foreign country stay),

and reacquire certificates (birth, no marriage, no criminal) from a correct authority in China...

While there is a possibility, there is absolutely no guarantee, and

things can easily pop up and kill few weeks here.

You should look into cancellation and rescheduling options,

and don't lock yourself into a timely processing that you have little control over.

Maybe TSC will pick up and transfer a bunch of cases to California ;) maybe December will be part of the transfer...hahaha....would be nice.

Wow! Thanks everyone for your answers.

As rescheduling won't be an option - for several reasons I won't enumerate here - I have some other options up my sleeve:

Option A: Cancel current submission and submit a new 129F with a California address (parents live in California and permanent address is there, PA is temporary) - then maybe routed to CSC and be done in 1 month with USCIS

Option B: Wait for TSC, if not done in time for the wedding, go with visitor visa, have the wedding reception, leave the country, wait for K1 to finalize, then fly on K1 and do a small civil "official" ceremony, then AOS and everything else

Option C: Cancel 129F, then more than 61 days before the wedding go with visitor visa, then apply for AOS from B2

Option D: Any other ideas out there?

Thanks for the help :)

How about re-scheduling your wedding to August 2016 (if there's a particular month/date you have your heart set on) and just making the marriage legal whenever they arrive in the US? Go to the courthouse, fulfil the legal requirements and then relax and plan a proper wedding for the following year. In my opinion this option is much less stressful. Whatever you decide, hope it all works out!

Option C is fraud due to premeditation.

Edit: Unless you leave the country at the end of the scheduled stay. But I see nothing wrong with Options A & B.
