my friend he not meet with her fiance due doctor not allow to travelling ,,,how they submit i129f? doctor already give letter she con,t travel ,,,

they are know each other around 3 years and they love each other they want each other they have facebook history , call history , skype recoding ,send each other pracel proof and many more proof they have ,, they submit petition behalf on layer or beself or they not allow i129f? please please help me ,,, they are very in tension :devil:

Hi,

One of the key requirements of a K1 visa is that they meet in person at least once within the last 2 years. The only way around this is for religious/cultural reasons, but very difficult to prove from what I've seen.

Being unable to travel due to medical reasons doesn't exempt them from this requirement. The proof they do have will help proof the ongoing relationship part of the petition, but they do need to meet in person at least once.

If she is the US citizen and the doctor will write a letter explaining why she cannot travel you may be able to get a waiver. Your friend would probably also have to show proof that he cannot travel to the US to meet her. (iex. denied tourist visa). I'm sure there are others on this site that can give much better info than I, but I do know firsthand of a friend of a family member of mine that was able to get a waiver because of a situation similar to this.

Why can't he visit her? They have to meet within the last 2years before filing. Hard to get around. You didn't say who was who and hard to work out so sorry if this is wrong but If she is not the US citizen how will she travel to move if they get visa?

I'm correcting my previous post because I forgot that extreme hardship is also a reason to waive the meeting in person requirement. I just wouldn't know what constitutes extreme hardship for this purpose. If the condition is so serious that you cannot travel, that should count, but you would need a lot of evidence to avoid an RFE or denial of the petition.

Say for example you had to get dialysis, this is something that is very expensive and has to be done every other day, that would be extreme hardship because of having to travel to another country where you might not have access to this or be able to afford the treatment.

The instructions do say that it can be waived due to extreme hardship. I would think that not being able to travel for medical reasons is extreme hardship depending on the condition itself and if it's permanent.

Yes but it goes both ways.

She cannot travel. He can.

They won't be able to get it waived. Because HE can travel still.

Unless he has a magical excuse that would count for extreme hard ship on his part too, then they cannot file for this.

Example- not too long ago there was a couple who had never met. He couldn't travel because he was on dialysis 12 hours a day. Which meant he couldn't travel (He was the USC), and she couldn't travel because she had finished school and her visas to visit were denied.

In the end, they were approved for hardship, got the NOA2, and then were approved at interview because they BOTH couldn't travel.

He needs a LEGIT reason, why he cannot go and visit her.

I'm aware that the beneficiary can travel to meet the requirement as well. However, I assumed that it wasn't a possibility for him to travel otherwise they wouldn't be considering a waiver.

He would need to actually apply for a tourist visa and have proof it is denied to submit with the petition. The OP didn't mention if he had applied for a visa already. If he applies and gets approved then of course he can visit and the requirement is met.
