Never Met My Fiance

Timeline

Me and my fiance were engaged through parents back in 2004. We were too young to accept the relationship we never talked till 2010 and now we talk 24/7 and are in Love, unfortunately I could never meet my fiance because of his medical issues he cannot travel at all as he is suffering from Chronic Renal Failure and needs everyday 12 hours dialysis. If he traveled he would die :( we have proof of online conversations, facetimes, pictures taken through webcam, presents he sent me on different occasions but not even a single picture together though I have few pictures with his family as his mother came multiple times.

Is this issue gonna affect our case? We already submitted a waiver from his doctor with the I129F application?

Also I am a Doctor recently graduated and pursuing my career in States, does any of the listed things can affect our case?

I did not go down the K-1 route, but Im sure I have read on this forum on many occasions that to apply for a K-1 you must have met in person, at least once, in a 2 year period... can any VJ members confirm this?

Yes, meeting is a requirement, not optional, to have met within the previous 2-years from the date you filed unless a waiver is also filed at the time the petition is submitted meeting the "hardship" provisions to exempt the beneficiary/petitioner from meeting.

This is what is stated on the USCIS website:

You met each other, in person, at least once within 2 years of filing your petition. There are two exceptions that require a waiver:

  • 1. If the requirement to meet would violate strict and long-established customs of your or your fiancé(e)’s foreign culture or social practice.
  • 2. If you prove that the requirement to meet would result in extreme hardship to you."

I also found this link here that outlines what qualifies as a hardship. (Just haven't had the time to read through it yet)

That being said, I'm not certain that a medical situation would be considered a "hardship" or not. Anyone have any thoughts on that?

As said by Corey, its a must requirement to have. Why don't you go spend some time with him? its almost impossible to get a K1 without its requirement and even then there are certain situations where you can skip that step and being sick isn't one of them.

Thank u Corey&Guyvens... As the OP is able bodied and technically able to visit her fiancé I would imagine that their situation would not be considered hardship.

OP... have you considered visiting your fiancé? And why has this not happened yet?

Because it might be very difficult for the fiancee in Pakistan to get a visa in the first place to visit the U.S., and now especially because she is engaged.

also I applied for an internship in some hospital again I got denied it was B1 that why Florida :\ my luck I got approved and I needed accommodation so what do I do????? Is it gonna be hard :(

Where does your fiance live? Perhaps you need to figure out how you can use that internship. Didn't you realize that you would need accommodations before you applied? Isn't this something that can be worked out somehow? This seems like your best bet.

I think the fact that you were approved for the visa to U.S. will mean that they won't accept that you couldn't meet in person.

internship thing is over it was last year now i am a graduate. For now we have applied for K1. My fiance lives in Florida and I had an accommodation at his place as were related his dad is my uncle

The goal of the lawyer is to make money off the client. If you get denied, he still gets his money. I wouldn't put my faith in a lawyer's word or lack there of.

Hmmm. Well, not sure that the government will accept your explanation for having not met. I suppose you can only just try.

So are you saying you got accepted to do an internship, but you never actually got the visa to do the internship?

I think if all means are exhausted in you trying to get a visa and the U.S. denying it, coupled with your fiance's medical condition, you should at least try for the hardship waiver. Whether they decide you qualify is another story and I guess you will only find out when you try.

Yes exactly!! I paid the money to the hospital and everything was ready but unfortunately I had to cancel it cuz my visa was denied


we did, we have submitted a medical waiver from his hospital saying that his suffering from congenital chronic renal failure and needs everyday 12 hours dialysis along with the I129F. We didnt lie or hid anything
