EAD NEVER DELIVERED..Hope this does not happen to you

Hi everyone,

Just wanted to post to express my frustration and complete annoyance over the absolute BS my husband and I have to deal with. After filling ALL paperwork properly at the appropriate times we never received my EAD even though it was 'sent out' over a month ago. I am in the US on a K1 visa. My husband and I got married and filed for my AOS on May 4 2014. After waiting our turn we received an email on August 1 2014 that I was to expect my EAD combination card in 2 days through USPS priority mail. I called USCIS after not receiving my card in the 2 day interim and they provided me with a tracking number. I was able to track the EAD online through USPS services. It said that it went out on the 1st of August and then...nothing. I called the post office from where it was sent out. Nothing. I called the post office from where it was suppose to go. Nothing. I put in an inquiry with USPS and waited a week to hear back from them. Nothing. I called USPS several times and they were unable to locate the package. They were unable to provide me with any information as to where it was.

I then proceeded to call USCIS. They gave me the 'wait 30 days until something turns up' runaround. I stated that it was lost in the mail for two and a half weeks and that it was ridiculous for me to wait another two weeks for something that I was not going to receive. I ask for them to send out a replacement card. USCIS informed me that it was not their responsibility that the card was missing. They told me that I would have to refile, pay again and wait the 60-90 days for them to process the paperwork...for something that I NEVER received.

Called congress and sent in all of my paperwork to them. Congress put in an inquiry with USCIS, which took a week. USCIS basically said the exact same thing to congress that they had said to me over the phone in terms of refiling. However, IF we can provide evidence that the letter was never delivered then we don't have to pay the $380 plus fee (unsure if I will have to redo biometrics..for the fourth time). Ok, back to USPS. Called USPS post master that I was dealing with, he would not write a letter admitting fault. He puts me in touch with USPS consumer affairs head. After a week and a half and several phone calls to her and her supervisor, we are getting a letter.

From here we are sending a package to congress with ALL of our paperwork and she will send it out on our behalf through her contact at USCIS. And we play the waiting game again.

If this does happen to you....contact congress ASAP. Do not wait, unless of course you enjoy that kind of thing. Keep a paper trail. Get IN WRITING everything that you can. Keep on top of USPS and USCIS. One person will tell you one thing and another will tell you something else. Get a letter from USPS ASAP. And if you have the extra cash to throw around, refile ASAP.

I can't work. I can't go back to my country to see my family. I can't get a social security number. I can't get a license. All I can do is wait and continue to do so. I really hope this doesn't happen to anyone else.

....in the mean time (this notice was received a week after my EAD was suppose to be in my hands, got this one no problem) I receive a notice that my I-485 is being 'reviewed as a possible interview waiver case' which will take an additional 9-12 MONTHS from the four months that I already have been waiting. I was expecting this in September of 2014.

That's horrible. What does it say on your USCIS status? When they delivered my card, it stated like this.

"The USPS reported that your new card was delivered on September 2, 2014, directly to the address we had on file. The USPS tracking number assigned was 920559233840xxxxxxxxxx. You can use this number at www.usps.com to view the detailed tracking information recorded by USPS for the mailed card. If you did not receive your card, or have any questions, please call our customer service at 1-800-375-5283."

I am so sorry this happened to you! I really don't understand what the heck is going on with USCIS :ranting: Thank you for sharing your story with us and providing this helpful piece of advice! I hope you receive your new EAD card soon and can get back to a normal life again!

I'm kinda in the same situation. I sent out my application for AOS since June 20th and on they requested for RFE which I sent back to them and is been 3 months now and I haven't heard anything. The status on the website is still on RFE. Is there a number I can call for them to confirm if they received my RFE? The mail was registered and needed to be sign for by a staff before it can be released. Plz I will need advice on what to do now. Is difficult staying at home all day considering the fact that I'm the man .

I was able to track it on usps.com. Shows that it was expected on August 4 2014 and the last known information was that it departed a Knoxville, TN location on August 1 at 10:04 pm. Status is 'in transition'. However, after several inquiries with several different USPS representatives it is unable to be located. One guy told me to call back USCIS and ask them if they even put it in the mail. Out of 16,000 pieces of mail that were sent out from the Knoxville, TN on August 1, mine was the only one that was not delivered.

Sorry to hear that this has happened to you. All the excitement of getting the card to production stage and then it getting lost in the mail must be hugely frustrating.

I'm glad you shared though as I was planning to book some flights some as soon as I get the approval. I'll not be doing that now.

We sent in 485, 131, and 765 around June 10. My wife just got her EAD/AP card Aug. 29, no notice, it just showed up in the mail box. I feel for you. It took us 15 months for her to get to the U.S. so I know how you feel. Now waiting for Perm Residence which I think should be about 9 more months? If anyone has a clearer estimate for the Perm Residence 485, let me know. Thanks to all at VJ !!

What if your wallet is stolen and you need a replacement? Don't they have a plan in place for replacement cards?! ?

That's rough.

The post office here is an absolute void. In a month and a half they lost 3 Priority Mail with Tracking items, both incoming and outgoing. One was my rent check, next was her EAD, and then her Green Card.

Go to the local post office with the tracking number. They can see more details than the website or terminal tracking will.

November 14th, 2013: She's here!

December 12th, 2013: Picked up marriage license.

December 14th, 2013: Wedding

Ya know, as expensive, time consuming, etc.... as this whole process is, one might think that instead of sending these cards through the regular mail, they could at least provide the option to pick it up in person from their local office. I'm sure most people wouldn't mind doing that and it would probably save money on postage. Oh, and it would spare many people from so much grief, frustration, time and money.

But that might make sense so....
