I know it is still early in the game, but, my bride to be does not want any witnesses at the Justice of the Peace wedding. I live in NC, are we required to get married in NC. They require 2 witnesses to the marriage and VA requires none. So i would like to get married in VA since I'm 20 mins away from there also.

any input ?

Provided you meet the requirements for marriage in that state, which may or may not involve a residency requirement.

As long as you meet the requirements for getting married in VA, then go for it. It doesn't matter the state you marry in.

Why the strange resistance to having witnesses to her wedding?

Does your bride understand that you need to show a bona fide marriage to get her green card. Having witnesses at your wedding sures goes to show that its a bona fide marriage.

we live in KY and had to get married in TN because they said "it's against the federal law to get married without SS card" . so we had to go to a different state. they gave us no problems.

When was that? I got married here in KY with no SS number - My only ID was foreign passport and foreign birth certificates etc...

I married early last year.

Short outline: AWA affected our application
2012 - married US Citizen from tourist visa (unplanned)

2013 - First application for AOS by marriage - with an attorney but not one with AWA experience

2013 - First NOID - Got Psych report and as much evidence as possible sent off

2015 - Denied

2015 - Reapply for AOS - same attorney but we are better versed this time

2016 - NOID - new reports, fresh proof

2017 - Denied

2017 - Reapply 3rd time - yet more info provided

2018  - NOID - 3RD Psych assessment, at $3000 a pop

2021 - Denied

2021 - Reapply BUT with a change - we switch application from my husband as a sponsor to my eldest step-son and suddenly, no issues

2021 - RFE for Medical Exam only!
2024  Jan 13 - email from attorney to say we have finally been APPROVED

You do not need a SSN to get married. There is no such law.

oh i know that. i know that they were absolutely wrong and i still have a temptation of giving them a middle finger every time i go by city hall haha.

this was back in 2011. when we got to the city hall, the lady was like:"i need your id a ss card". well, i told her i didn't have one. she, being a typical hilljack of SE kentucky who has not seen a person from another country except for the chinese and mexican restaurants., told us that we can't get married without the SS card.

we asked them (since it was illegal in ky) if we can do it in VA or TN since its just a 5 min drive away to either state, and she said that "it's against the federal law" (#######???)

well, 20 minutes later i called the TN courthouse and they were like, bring in 100 bucks, we'll marry you.

she was just so uneducated about the whole deal that instead of researching it and calling her boss, she made up a federal law.

btw. the lady was a city hall clerk/big lots cashier...

I get this completely. I don't really want any witnesses either at our courthouse wedding, because we aren't telling anyone about getting married early; we're having a larger wedding in October, and don't really want to tell the people traveling 1000's of miles that they're at the pretend wedding because we already got married.

If you're not a same sex couple you can get married in any state you like.

I think (not 100% sure) PA, NJ, VA, and AR are the only states you don't need a witness and I know in Las Vegas some places will provide a witness for you. You usually need at least one and most of the time two witnesses at a court wedding ceremony.

Its kinda like that, her parents can't travel in january when we do it because its hard for them to get off that time of year. So she asked me and we agreed that if her parents can't see her get married then no one should. It's just on paper, we are having a big ceremony and reception back in canada a year and a half later (summer of 16) it makes since to me. and i don't want to show favoritism toward my family just because they live here.

And yes we can get married in VA it is only 20 mins away and 1/2 the cost of NC. I just thought it to be unfair to her to have my family/friends there and no one from her side.
