pls, is it marriage license or the actual certicate that's required?

You need the certificate, that's the only thing proving you got married. License only prove you went to the court house and ask for a license to get married but doesn't prove you actually married.

Do you guys know if the US Citizen needs to fill out the G325A as well? The immigration officer at USCIS gave me a list of all the documents and wrote (2) next to it but everyone here seems to just have one for the non us citizen.

No, only the person adjusting status needs the G-325A.

Don't know if it's said earlier because I'm in the process of writing the cover letter as we speak but I want to point out that at the Infopass I had with USCIS they told me to send the original NOA2 and not the copy.

Then they do not know the I-485 instructions.

B. Based on admission as the K-1 fiancé(e) of a U. S.

citizen and subsequent marriage to that citizen

Attach a copy of the fiancé(e) petition approval

notice, a copy of your marriage certificate, and your

Form I-94, Arrival/Departure Document.

Also, the instructions do not ask for a G-325A from the USC spouse, only the from the I-485 applicant seeking permanent residency.

Hello fellow VJ'ers!

Im ready to send in my I-485 package and am including the I-765(Application for Employment Document) and the I-131 (Application for Travel Document). I attached 2 passport photos to the G-325A form. Do I need to also attach 2 passport photos for the I-765 and another 2 photos for the I-131?

I copy, pasted, and modified my I-485 Cover Letter from the original poster of this thread and noticed he had sent multiple copies of the marriage license, NOA approval letter, I-94 forms, and passport photos (which someone posted was unnecessary) so I only sent 1 copy of each for all the forms as I am assuming UCSIS makes there own additional copies per form if needed?

All that said...do I need to send 6 total passport photos are just 2?

Couldn't be more grateful for all the help we have gotten from VJ! Wouldn't have gotten this far without all your help!!!

The only documents you need for the EAD and AP are:

EAD

  • 2 passport pictures
  • Copy of bio page in your passport

AP

  • 2 passport pictures
  • Copy of bio page in your passport
  • Copy of your K-1 visa

You only need to send in a copy. You should always keep the original for your records. We only submitted the copy and there was no issue at all.

Hi Zedayn,

Yes we received an RFE for relationship proof, and so we just responded back with pictures and other relationship evidence. My wife was approved shortly after they received our RFE response.

No, you don't need to include relationship proof with your I-485. It won't hurt to include some proof if you want to, it's just not a requirement to send it.

Hi there, just read this post and it caught my attention because I haven't seen anybody who was adjusting from a K-1 get sent an RFE for relationship evidence.

Being a K-1 marries within 90 days of entrance and usually does not wait long after that before applying for AOS... there's not a whole lot of evidence we can collect in just a few months time. Did you include a cover letter saying something to that effect or did you just send in your evidence?

If you don't mind sharing.... besides the pictures what else were you able to send?

We did include a cover letter, but it just listed the contents of the AOS package. It is not required to submit relationship evidence with the AOS, so we never did. We only sent the required documents. It took us about 10 months or so to hear anything on our case, which was the RFE we received. By this time we did have some evidence, which we included. If I remember right, we included joint statements from our bank account, copies of insurances, copy of our lease, and about a dozen photos. We only included what we had at the time to include, and we were fine.

Sounds good, that's what I was thinking too in regards to what kind of evidence we could have in a few more months. I'll start collecting and preparing just in case.
