Last night at 1:12 in the morning I received a false checklist for my IV package. Even though I read it and realized it was false I still had the most awful feeling in my stomach. Why do they do this to us?!?!?! It's so stressful. LOL! Hope this will mean case complete very soon! smile.png

Now that we finally got our case number, I am being extra careful looking over our documents to make sure we've made no mistakes.

I've seen lots of mistakes people have made on the I-864 so I just wanted to clarify something...I've read all the posts for the last 2 months but haven't seen any question that exactly fits mine.

I, the petitioner, have been living with my husband for the last 2 years as we wait for his visa. I have a job here that pays nearly enough, but will be needing a joint sponsor. In terms of the question about current individual expected income, I am not sure what to put.

1) I have seen people saying that this income must be income that continues in the U.S...if that is the case, that answer is no, so my current income would be $0.

2) However, let's say my husband doesn't get his visa anytime soon, I EXPECT to stay at this same job the entire year, in which case I intended to estimate what I earn annually based on my current monthly salary. So, I multiplied these last two paystubs to find my expected annual total. I have already translated and made copies of the paystubs just in case, and I have declarations of income for the last year which show the same salary. Is this the correct number that I need, if I am allowed to count this foreign income that will end whenever my husband gets his visa?

3) To prove my employment, albeit at a job that wouldn't continue in the US, I have my employment contract (with renewable end of contract date July 31st) ready to go as well. If my husband's visa were to take a long time, I would have this visa renewed at the end date and my same salary would continue. Would that be clear enough to the NVC folks or would I, given that I count this current income to last the whole year, include an explanation?

So...given all of those conditions, I am not exactly sure what to write in. I honestly expect to quit my job at whatever moment that my husband has his visa.

I hope I am not overthinking all this- just don't want to make any mistakes and get set back again! Thanks in advance for any responses that may help.

I also live and work abroad. And this is how I understand (I hope someone else weighs in if I say something wrong)

1. Current annual income I wrote $0. Our income abroad does NOT count towards poverty line if your income will not continue in the USA. I wrote I am employed, but income does not count. I think I'll throw something about that in the cover letter just to be certain they understand.

2. Again, your current income does not count unless it continues when you move to the USA. You either need enough money in assets or you need a sponsor.

3. You don't need to send in pay stubs or anything because your income won't count. No need to send in contracts, etc.

Also, you do need to prove you have been filing taxes. If your income in under 90K a year you don't have to pay taxes on foreign income, but you do need to file taxes. For example, for 2012 my income on my taxes is actually a negative number because I lost money in stocks and didn't "earn" any money in the USA.

Finally, you'll need to prove that you are moving back to the USA. There's a letter and examples of how you can do that on the first page of this thread. :)

I am new to this forum and I have a question:

When i filed I-130 for my wife, I also submitted G325A for both of us. We got I-130 approval also. But now i realized in my wife's(Beneficiary) G-325A, she made a mistake while adding Applicant's residence last 5 years. She forgot to add one address in that section. Will that be a problem while filling out DS-260 in the NVC stage or during the interview?

No. Just mention it at the interview, but it's not a big deal.

Update from our end: I called NVC this morning to inquire about Case Number and it was indeed uploaded! So, from Feb 6 date when they received our file from USCIS to March 15 (or probably March 14), I count 5 weeks elapsed or 25 business days, in line with the quote that NVC operators provide of 20-30 business days. Saylin, please update spreadsheet.

I paid my IV bill last Thursday, the 6th and it cleared my bank already, but it's still showing in Process over a week later. Will this slow down my process and is this normal? Thank you my VJ Family!

Same thing for me on my AOS. Since its been more than 5 business days, I suggest you call NVC and report back, as I'd like to know what they tell you. :)

For example, for 2012 my income on my taxes is actually a negative number because I lost money in stocks and didn't "earn" any money in the USA.

You know, I had a friend who did the same process a year ago and sent the same info I mentioned (we had the same jobs, husbands in the same country, etc) even though her income didn't necessarily count. When she gave her income, paystubs, contract, etc, the NVC approved her, even though the income wouldn't continue. I'm starting to think she got lucky because everything people are saying on here seems to be against that- her income shouldn't have counted either!

In any case, I have a sponsor, so no biggie :) It makes things easier, even, although all my hard work to translate and copy stuff went a bit to waste. Already have taxes under control and domicile as well.

Hi

Got two checklists last night. Think the first was a false one as it was requesting documents to be sent.

However the second one baffles me !! It says:

In Part 6. Sponsor's Income and Employment, please correct the following...
[x] Items 13.a.1. The income you enter must match the total (gross) income reported on your most recent Federal
income tax return. If you filed Form 1040EZ, use the adjusted gross income instead.
Cannot understand this as my husband entered the amount on the 1040 and put the same amount in question 13.a.1. Think my husband will have to call them when he finisheds work sad.png

ok so I think the first one was not a false checklist... they said they did not receive the IV package for me. I just received a checklist for my daughters petition saying they did not receive her I864!!! I cannot believe this. It is not possible. I sent both my IV package and my daughters in the same envelope. Then I sent both I 864 s in the same envelope. So if they received 1 I864 they received both and the same for IV package.. I am freaking out now , have they lost all my original docs or what???

That is interesting she got approved! I'm not going to risk it even though my current income is enough for 125% above. I'd really like for somewhere along this awful visa process for things to go quickly and smoothly. ;)

Saylin, given my income is foreign and counts as $0, am I eligible to use the I-864EZ? I meet the first two conditions (only sponsoring one immigrant, my spouse), but am a little unsure about the third:

Since I have no salary to qualify and no other source of revenue besides my uncountable foreign income does this work by default or is it better to use the regular I-864 to be safe?

I am the petitioner (USC). My husband is Senegalese.

6/10/2013: NOA1

1/21/2014: NOA2 (TSC)

2/6/2014: Received at NVC

3/13/2014: Case Number, IIN, BIN received by phone. Emails handed over.

3/17/2014: Submitted DS-261

3/18/2014: Received emails- AOS invoice and Case Number, IIN, BIN

3/19/2014: AOS available and paid (IN PROCESS)

3/19/2014: My part of AOS sent to joint sponsor from Senegal, awaiting PAID confirmation before joint sponsor sends to NVC

3/21/2014: AOS payment REJECTED. Paid again, payment IN PROCESS. Joint sponsor received AOS package in US

3/24/2014: AOS Payment went through account. Still in process at NVC.

3/25/2014: AOS PAID. IV Yellow Triangle in the morning. IV email and payment invoiced in the afternoon. IV payment IN PROCESS.

3/26/2014: IV payment taken out of bank account, still in process at NVC. IV packet sent via DHL from Senegal.

3/27/2014: IV shows PAID. DS-260 Submitted. AOS sent to NVC from Oregon.

3/28/2014: AOS and IV delivered (both signed by G.Peters)

4/1/2014: Both packets in the system

4/14/2014: Fake checklist for AOS. IV assumed accepted (will call to verify)

4/15/2014: Case complete (by phone)

4/22/2014: Case complete email

5/1/2014: Interview scheduled (confirmed by phone)

Interview

6/25/2014: Interview date!
