Inlaws from China wish to extend their stay???

Ok this is the rundown..Mom and dad here from China with a one yr tourist visa till Feb 2014...I94 exp Sept 18...they have been here 4 months....we want them to stay longer...till their visa exp in Feb...what would be our best course to follow here...any help is welcomed. And the I539 does not state in the directions to use 2 forms and pay 2 fee's.....and on the i539 there are sections for adding more applicants too...Im just confused and the wife is about to kill me....cant get a answer from the USCIS either...just a machine...So anyone who has done this Id like to hear from ya...Dan and Xiangxiang in Ohio

Save your self the time, money and frustration of them being denied and have them return to China in September before the I-94 expires. They can then return the the US anytime before February 2014. They might be able to leave in September and return in November and leave late January and return in February 2014 and stay for 6 months--assuming the CBP gives them the full 6 months. Just remember that the CBP determines IF they are allowed into the US and how long the stay is to be. I like Darnell's approach of leaving in September and returning again around Xmas and staying another 6 months. Easier to do then trying to come and go several times in one year. I would not waste any more effort on the extension as there is a very good likilihood it will be denied--I do not think they have a good reason for an extension to be granted, plus they have a multi-entry one year visa and will be told to leave and just return before the visa expires.

Well just to let those know who said it wouldnt be possible for my in-laws to get an extention on their visa to stay in the states longer ...we just got notice that they were approved and can extend their stay...I must have had some good luck or wrote one heck of a letter for them to get it...and the guy who said good luck with that and let us know how it works out....SEEEEE....I got the extention and you and your smart azz comments didnt effect my pursuit to achieve this...Im kinda happy now as they can stay longer and to know the ones on Visa Journey who helped me thru all this are the best people on this site...to you haters and non beilievers who do nothing but give us trying to do things like this headaches with your stupid comments you all can suckit...Thanks again to all the good people on this site and I am in debt to your wisdom.....Have a great year all....Hoopy

From what I have sen getting an extension is quite likely, the percentages I do not know, not enough valid date.

The downside comes if they want another visa, that is where it can get tricky.

So my view is that if you have no future need to visit then what the hell go for it.

Nobody in this thread said it wouldn't be possible for your in-laws to get an extension. Some were trying to persuade you against it with very good reasoning. The most important reason being that once a person has received an extension on a visitor visa, their likelihood of getting another tourist visa in the future diminishes. In my opinion, you should have taken Darnell's advice.

Congratulations - on the baby and the ability of your in-laws to visit. I have to admit that I am jealous of your experience but I wish you nothing but the best. Now that your issue is taken care of I would appreciate it if you could share any advice to those of us who have not had your level of success. Please take some time to look at the thread I started about the experience of my in-laws attempting to come visit when our daughter was born (under tourist visa forum - titled: Petition re: visa for wife's parents). If there is something that you can let us know I would appreciate that. If you just had better luck due to the inconsistency of the application process I would certainly not be surprised by that. I would especially be curious how your in-laws were able to demonstrate ties to the home country which would compel them to return after a brief visit but then were able to stay as long as they have and then receive an extension. Thanks.

I'd say this depends entirely on how soon they 'need' another visa. If they return to China and immediately apply for a new visa, chances may be slim. However, if they apply for a new visa in i.e. 2016, shouldn't be a big deal. At no point did they break any law, and they returned to China before their (new) I-94 expiration.

Well the reason i was pissed is cause Boiler seemed like a smart azz and said well let us know how that works for ya...seemed like he was being a azz...but no they dont plan on comin back to the states and this will be the only time they will come so its all good...So I will close this thread and say thanks to all who helped and have a wonderful year and happy holidays...Hoop
